1. Here's how you can register a utility model with the Intellectual Property Office of the Zamboanga City in person. But, before you start your application, you will need to do a quick search using IPOPHL's database first and read documents about utility models. Try to look for models that bears similarity with the one you are applying for. If you can, do a little bit of research. 2. Next, you will need to fill out three (3) copies of the Utility Model Application Form (link to download the form can be found under 'Documents to Use' section).
3. Attach the following documents to your application:
   1. Specification and description of the utility model:
      • The Title
      • A brief statement of its nature and purposes
      • Brief explanation of the drawings, if any
      • Complete and detailed enabling description
      • Distinct and explicit claim or claims which the applicant seeks to be protected
      • Abstract of the invention
   2. Drawings of the utility model
4. Submit all the required documents and pay the application fee at the IPOPHL cashier.
5. Your application will be examined by IPOPHL. The Office will also publish your application for 30 days.
6. Once approved, a Certificate of Registration will be issued to you. Also, the IPOPHL will publish the newly registered UM.

A utility model can be registered if it is a product or an invention that offers a technical solution to a problem in any field of human activity which is NEW and INDUSTRIALLY APPLICABLE.

Who can file the application: The utility model application can be filed by any individual or juridical entity. For applicants who are non-residents of the Philippines, they must appoint a Resident Agent or Patent Attorney.

For small entities (with 100M worth of assets or less):

• Filing fee (up to 5 claims): PHP 1,720
• Claims in excess of five (5): PHP 120
• Registrability Report: PHP 630
• Issuance of Certificate of Registration: PHP 600

For big entities (more than 100M worth of assets):

• Filing fee (up to 5 claims): PHP 3,600
• Claims in excess of five (5): PHP 240
• Registrability Report: PHP 1,320
• Issuance of Certificate of Registration: PHP 1,200

Note: Total fees to be paid may vary depending on the number of claims, classes and embodiments applied. All fees are subject to 1% Legal Research Fund (LRF) as required by R.A. 3870. If the fee is below P 1,000.00, the LRF is P 10.00.

The registration of a utility model is valid for seven (7) years from the date of filing, and may not be renewed.

Having your Utility Model (UM) properly registered with the Intellectual Property Office of the Zamboanga City gives you the right to prevent others from commercially using your UM without your authorization, provided that the UM is new based on the Registrability Report. Compared with invention patents, it is relatively inexpensive, faster to obtain, and with less stringent patentability requirements.

The provisions regarding “Non-Patentable Inventions” as stated in, Rule 202 of the Regulations for Patents (Part 2) shall apply, mutatis mutandis, to non-registrable utility models:

1. Discoveries, scientific theories and mathematical methods;
2. Schemes, rules and methods of performing mental acts, playing games or doing business, and programs for computers;
3. Methods for treatment of the human or animal body by surgery or therapy and diagnostic methods practiced on the human or animal body. This provision shall not apply to products and composition for use in any of these methods;
4. Plant varieties or animal breeds or essentially biological process for the production of plants or animals. This provision shall not apply to micro-organisms and non-biological and microbiological processes.
5. Provisions under this subsection shall not preclude Congress to consider the enactment of a law providing sui generis protection of plant varieties and animal breeds and a system of community intellectual rights protection:
6. Aesthetic creations; and
7. Anything which is contrary to public order or morality.
