Uganda - Replace a Certificate of Title


Procedure

  • If a duplicate(owners)certificate of title is lost or destroyed or becomes obliterated, persons with knowledge of the circumstances surrounding the said certificate may make a statutory declaration stating the facts, particulars of all encumbrances affecting the land title to the best of the declarant’s knowledge and belief.
  • The first step is for the person interested to make an application by a formal letter to the Registrar and attached a statutory declaration declaring the facts surrounding the lost certificate explaining when it was obtained when it was last seen and how it was possibly lost.
  • If the Registrar is satisfied with the truth contained in the declaration, a notice shall be publicized in the Uganda gazette of the Registrar’s intention to issue a special certificate if no objection is raised within a period of 30 days.
  • If no objection is raised, then the registrar will proceed to grant a special certificate of title after payment of the relevant fees and stamp duty.

  • Two recent passport photos
  • Photocopy of the original land title
  • Identification ID i.e National identification Card
  • General receipts of payment.
  • Letter of application for Land title Replacement title
  • Gazette extract
  • Statutory declaration form

Eligibility

Anyone who lost original land certificate of occupancy, torn or destroyed,can apply for a special land title.


Fees

  • Registration fees 15,000
  • Stamp duty 10,000
  • Application fees 10,000
  • Bank fees 2,500

Validity

A replaced land title has no validity period as long as it is issued by the authorized body and there must be a genuine cause for requesting for one.

Instructions

  • Visit the ministry of lands to acquire necessary application forms and accurately fill them.
  • Make copies of all the necessary documents.
  • Make all payments; and
  • Submit application to the land office.

Required Information

  • Full name and address of applicant;
  • Details of the Land in question i.e. location, plot and block numbers;
  • Details of original owner.
  • Area Land Committee Report
  • District Land Officer Technical Report
