Tamil Nadu - File for Divorce


Procedure

Apply In Person:

  1. To File for Divorce, the applicant has to hire a lawyer and visit the high court. Find contacts in the following link:Link
  2. Now file a petition in court with all the necessary details.
  3. Make sure to provide all the "Required Documents" along with the application
  4. Pay the lawyer fee and court fee as mentioned below
  5. A copy of notice will be sent to the spouse via court upon which he or she can contest or consent.
  6. Both the candidates have to provide proof of staying apart for more than a year
  7. The court, upon applying, will give a period of 6 months to reconsider the decision.
  8. In case, the applicant doesn't withdraw the application, the court grants the decree to divorce.

  • Details of your profession and your present remuneration
  • Personal information (birth, family members etc)
  • Asset ownership details
  • Address proof of husband
  • Address proof of wife
  • Marriage certificate
  • Four passport size photographs of marriage of husband and wife
  • Evidence proving spouses are living separately since more than a year
  • Aadhaar card
  • Evidence relating to the failed attempts of reconciliation
  • Information relating to family background
  • Submitting copies of outrageous acts like putting up advertisements in newspapers, if any.
