Scotland - Register a Civil Partnership


Procedure

There are two steps needed to register a civil partnership. The first step is to give notice of the applicant’s intention to register and the second is to actually register the civil partnership.

Apply In-Person:
Step 1: Giving Notice

  1. To Register a Civil Marriages/Partnerships, the applicant has to approach the nearby Local Register Office link
    Note: The applicant has to enter their Postcode to find nearby offices.
  2. Both partners will each need to give notice of their intention to register a civil partnership to the local register office where you live.
  3. An application form will be provided to the applicant by the Registrar. Or the applicant can download the application form from the following link
  4. The applicants have to provide all the necessary details in the application form.
  5. Make sure that the applicant has to provide all the necessary documents that are mentioned in the “Required Documents” section of this page.
  6. The applicant need to pay a fee to give notice of his/her intention to register a civil partnership and a registration fee. The fee depends upon where the applicant wants to register his/her civil partnership. The applicant should contact the venue for details of the fees.
  7. Once the applicant has given notice of his/her intention to register a civil partnership, details from the notice will be made available in a register office for people to see.
  8. This will be in the area in which both of the applicant lives and the area where he/she is going to register, if this is different.
  9. The details must be made available for people to see for 28 days before he/she can register his/her civil partnership. This is to give an opportunity for objections to be made.
  10. After 28 days, the applicant will be free to register his/her partnership, if there are no objections and no legal reasons why he/she can't go ahead.
  11. The register office must give the applicant a legal document called a civil partnership schedule which he/she will need in order to register a civil partnership.

  1. The applicant can register their civil partnership in any register office or at any venue that has been approved to register civil partnerships.
  2. Anywhere that has been approved to hold civil marriages automatically has approval to register civil partnerships.
  3. After registering, the authority will issue the registration certificate.
  4. The applicant has to pay the prescribed fee to obtain the certificate.
  5. The entire process can be completed within 30 -45 days or as per the timeline advised by the respective department authority.

  • Evidence of where the applicant lives, for example a bank statement with his/her address
  • Divorce certificate if the applicant or his/her partner were previously married
  • Dissolution certificate if the applicant or his/her partner were previously in a civil partnership
  • A death certificate if a previous spouse (husband or wife) or civil partner has died
  • Passport or another document that provides evidence of the applicant’s nationality
  • Certificate that the applicant is free to marry under the law of his/her own country if he/she does not live in the UK

Eligibility

The applicant can have a civil partnership in Scotland if he/she is:

  • Aged 16 or over
  • Not married or in a civil partnership with someone else
  • Not closely related (see below for a list of relatives the applicant cannot have a civil partnership with)
  • Of the same sex
  • Mixed sex (from June 2021)
  • Capable of understanding what a civil partnership means and of consenting to a civil partnership
