  4. With the applicant’s partner and have open and honest discussions about the key issues that need to be addressed in the separation agreement. These may include child custody and visitation, division of assets and property, spousal maintenance, child support, and any other relevant matters.
  5. Make a comprehensive list of the terms and conditions the applicant and his/her partner have agreed upon. Ensure that all important aspects are covered and clearly defined in the agreement.
  6. Both parties should provide full financial disclosure, including income, assets, debts, and expenses. This transparency is important for ensuring fairness and accuracy in the agreement.
  7. If the applicant has children, their best interests should be a priority. Determine custody arrangements, visitation schedules, and child support provisions that are suitable and fair.
  8. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
  9. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
  10. The applicant has to attach photocopies of the required documents along with the application form while submitting it.
  11. The applicant must pay the required fee as instructed by the authority.
  12. Consult with the applicant’s solicitor to draft the separation agreement. Ensure that the document accurately reflects the terms agreed upon by both parties and complies with Scottish law. Each party should carefully review the agreement before proceeding.
