• Following are the steps involved in setting up an online ecommerce business.

Apply In-Person:

1. If an individual or a partnership firm or a registered company intends to start an online ecommerce business, please follow the below steps.
2. Please select a name for your company/trade/businessand for your online portal.
3. Please follow our “India - Register a Firm” procedure to get your company registered. Link for the procedure link
4. Once the firm is registered, the applicant will get memorandum of association and director identification number. If required, please apply for the trademark registration.
5. Please register your website domain. Having a company name and domain name registered, please apply and obtain “GST Identification Number”.
6. Please follow our “India - Register for Goods and Service Tax Identification Number (GSTIN)” procedure to get your “Goods and Service Tax Identification Number (GSTIN)”. Link for the procedure link

8. Applicant shall also obtain the shop and establishment license.
9. Now it’s time to open a bank account for your business. Please open a bank account.
10. Once the above initial set of actions are complete, then it is time for the proprietor to amend Privacy Policy, Website Terms and Conditions and Website Disclaimer for their website.
11. The next step is to enroot the online payment to your bank account. To do so, one has to set up the required payment gateway for their online transaction.
12. There are many payment gateway service providers to choose from. Please go through their terms and conditions and also pick the one suitable for your business territory.
13. Oncethe above said steps are completed, the business entity will have a business name, a website, “GST” number, “PAN” card, online payment gateway enabled bank account and set of rules and regulations.
14. This makes a website to start its business. Thus, an ecommerce online business can be established.

Note:

• The shop and establishment is mandatory under the respective state act for every person who is starting any commercial activity like a shop or business. Any shop or commercial establishment must apply for Shop and Establishment registration within 30 days of commencing operations. The Application must be submitted to the local municipal corporation of the respective state for getting the license. Even a small trader or a service provider would require this license if he is doing any business or commercial activity. This Act was mainly enacted to regulate the conditions of workers and employees working in a shop or commercial establishments.
• Those who are involved in ecommerce business (online sales of goods), need to follow the rules and regulations set by their respective states.
• Please register your start-up with start-up India link and obtain the appropriate recognition from the “Department for Promotion of Industry and Internal Trade (DPIIT)”to get eligible for the government benefits.

• Applicant proof of address (Ration card / Bank pass book / Telephone bill / Aadhaar card)
• Applicant proof of identity (Voter ID / Passport / Aadhaar card / Driving licence)
• Partnership deed in case of partnership firm
• Business licence
• Trade or shop and establishment license
• ”PAN” of the proprietor or the firm
• ”GST” registration certificate
• Bank statement / first page of pass book / printed cancelled cheque is required for bank account proof which must contain account number & IFSC Code
• Aadhaar card

• If a company is planning to start this business, then it needs to be registered.

• The fees or charges required to obtain domain name, company registration, “GST” registration, “PAN card registration should be paid as appropriate.

• The online business is valid as far as the domain name is renewed and active.

• Any business establishment attracts government tax. This business setup provides a way for the government to keep track of enterprises operating in the digital domain and keep track of tax revenue.
• When doing online business, one has to ensure that their business is a legal entity. To prove this, you should follow our procedure.

• Intra state tax is applicable, when the sales are within the state. In case of other state sale transaction, interstate tax is applicable.
• Please follow government’s announcement to avoid unnecessary actions for not following the policy.
• The applicant should ensure that his/her e-mail ID and mobile number are correctly filled, as all updates/status regarding the updates on new policy will be communicated through e-mail and “SMS”.
