Companies and businesses can apply for an operating permit to start a project that may have environmental impacts through the Ministry of Municipality and Environment (MME).
Apply In-Person
- An applicant (Companies or businesses) can make an application for an operating permit to start a project that may have environmental impacts by visiting the offices of the Ministry of Municipality and Environment (MME).

- At the offices ,the applicant will be given a Application form for Operating Permit Authorization form to complete.
- The completed application form is to be forwarded to the licensing authorities along with detailed drawings, and other required documents and data including a study of the environmental impact of the project. A list of the required documents are mentioned in the “Required Documents” section of this page.
- Make the appropriate payment as pre the advice of the authorities and submit the acknowledgment receipt to with the application form.
- Before granting the operating permit for the project, the licensing authorities will to forward the Application Form along with those attachments to the Secretariat General for consideration and review.
- The Secretariat General may seek assistance from experts and/or competent public or private agencies to review the project environmental impact study in accordance with the standards, specifications, restrictions, measures and conditions prescribed in the Environment Protection Law
- The Secretariat General shall review the project Environmental Authorization Request in view of the duly completed Application Form and its attachments and any other documents so required in conformity with the standards, specifications, restrictions, measures and conditions prescribed in this Environment Protection Law
- Based on this review, the Secretariat General shall recommend one of the following:
- (i) Approval of the environmental authorization (clearance) for the requested activity or project or any expansion or renovation thereof.
- (ii) Conditional approval of the environmental authorization (clearance) of the project upon implementation of specific environmental requirements or measures.
- (iii) Disapproval of the environmental authorization.
- Within ten days of receiving the duly completed Application Form and the environmental impact study, the Secretariat General shall forward a report to the Council giving its findings, including the reasons for their recommendation, pertaining to the project environmental authorization request.
- The Council shall give its decision regarding the approval of the authorization request within ten days of receiving the Secretariat General’s report.
- If the environmental authorization (clearance) is not granted, the reasons for that rejection shall be clearly stated.
- The Secretariat General shall inform the licensing authorities with the decision of the Council through registered mail within ten days of receiving the duly completed Application Form and the environmental impact study
- The Secretariat General shall issue the authorization for the operation of the project (Permit to Operate) within thirty days of receiving the duly completed Application Form and its enclosures.
- If the thirty-day period lapses without reply, it shall be considered a rejection of the Permit to Operate.
- However, the Secretariat General shall notify the licensing authority and the applicant by registered mail within ten days of the decision of the rejection of the Permit to Operate, in accordance with the procedures and formalities for obtaining authorization for the operation of a project

Instructions
- This Application for a Consent-to-Operate (operating permit) shall be completed in block letters and submitted with relevant supplemental information to: MME
- All sections in the permit Application may not be relevant to every activity. However, the Applicant should look through the complete form and provide all relevant information. All questions must be answered. If any question is considered (not applicable) (N/A) the reason should be stated in full
- Where attached sheets and other technical documents are utilized, indicate appropriate cross-references. MOE will take all available information into account in reviewing the Application. Unclear, incomplete, or improperly filled out Applications will be returned to the Applicant.
- This Application consists of two parts: Background Information, and Further Information. The completed Application may be subject to further verification and review. However, if you wish any information in your application to remain confidential please enclose a statement with your completed application stating the reasons in full
- Ministry of Environment ( MOE) is not responsible for delays arising from submission of incomplete information

Need for the Document
- Companies and businesses need an operating permit (Consent-to-Operate) to start a project that may have environmental impacts.
- The purpose of this is to protect and preserve the quality and natural balance of the Environment . The operating permit seeks to combat different kinds of pollution; avoid any immediate or long term negative impacts as a result of economical, agricultural, industrial and construction development plans and programs or other developmental programs which aim to improve the standard of living, achieve the Environment integrated protection, and conserve quality and natural balance thereof; and enhance the environmental awareness and principles of controlling pollution.

- Before any CTO is given out, the ministry must receive a completed application from a certified environmental consultant. - The EMP starts off with all formal information about the company and runs through to particular environmental management related to society and surroundings. Since the plan includes all stakeholders in your business, it is important to identify these and show how you manage your activities to protect them from negative impacts.
- Having identified inputs, outputs and all of the possible effects that your business activity has on its surrounding; the process of quantifying can begin. By using certified equipment and trained personnel, all applicable polluting factors are recorded and compared to baseline acceptable levels as found in related international standards. Where needed, a consultant may help identify and organize the required works to fully comply to the norms.
- Since management of threshold exceeding pollutants can be quite costly, the Ministry reserves the right to grant a conditional CTO. In this CTO, the conditions and deadline that the company needs to fulfill will be stipulated. This way, the business may continue to operate legally, but must rectify any positions where it does not fully comply with requirements.
- All going smoothly, the application will be submitted to the authorities for revision. If the requirements are met and the activities of the business are properly managed, the MME will grant a CTO with a corresponding expiration date.
- Any proposed public or private project or development plan, regardless of type or location, including industrial, agricultural and infrastructure projects, shall be submitted to the Council, prior to construction, for review and modification (if necessary) and to ensure that the projects comply with scientific and practical environmental planning methods, in conformity with the standards, specifications, restrictions, measures and conditions prescribed in this By-Law.
- The Council shall, by coordination with the competent Administrative Authorities ,lay down the necessary criteria, specifications, basics and restrictions for assessing the environmental impact of the Projects and Establishments, which require licensing. In particular the Council shall carry out the following:
- Determine the categories and sections of the public and private development Projects, which by their nature are harmful to the Environment.
- Determine the environmentally important areas and location as per the Environment Protection criteria. The Executive Regulation shall determine the procedures for the Environmental Impact Assessment (“EIA”) and the conditions for the environmental licensing of the Project or the operating permit, the cases of withholding or cancellation thereof.
