Philippines - Change Marriage Contract Date

Apply In-Person:

  1. To make an application to change the marriage contract date, the applicant has to file a verified petition in the local civil registry office of the city or municipality where their marriage certificate was registered to make the application.
    • If the applicant no longer reside near that particular local civil registry office, they can file a petition intheir current residence’s local civil registrar.
    • If you’re living abroad, you can file at the nearest Philippine Consulate.

  3. At the Civil Registry Offices, the applicant should approach the Customer Service Counter and file the petition for correction of the marriage contract date.
  4. The petition for correction of the marriage contract date shall be in the form of a notarized affidavit. The petition must contain the following:
    (i). The facts or merits of the petition
    (ii). Information showing that the petitioner is competent to testify about the matters stated in the affidavit
    (iii). The erroneous entry or entries to be corrected and the proposed corrections i.e. Contract dates.
  5. The applicant will be required to submit all the documentary requirements together with the petition to the Civil Registration Officer. A list of the required documents can be found in the “Required Documents” section of this page.
  6. The petition and its supporting documents must be filed in three copies to be distributed as follows:
    • First copy – to the concerned city or municipal civil registrar or consul general
    • Second copy – to the Office of the Civil Registrar General
    • Third copy – petitioner’s copy
  7. Upon submission of the petition and required documents, the Civil Registration Officer will check the documents for completeness and authenticity. If everything is in order the applicant will be required to publish the local dailies.
    • Section 5 of RA 9048 requires the publication of the petition at least once a week for two consecutive weeks in a newspaper of general circulation.
  8. After the publication period, proceed to make payments for processing the petition. The city or municipal civil registrar and consul general are authorized to collect reasonable fees for the processing. The application fees to be paid are mentioned in the “Fees” section of this page.
  9. Upon making payments proceed to submit the Official Receipt to the civil registrar or the consul general.
  10. Upon receiving the documents, the civil registrar or consul general will evaluate the petition. If it complies with the required format and contents, it will be posted in a public place for 10 consecutive days.
  11. After completing the posting or publication requirement, the civil registrar or consul general will approve or deny the petition within five working days.
  12. Upon approval of the petition, the Civil Registration Officers will approve the petition and send it back to the Local Civil Registrar for Certification.
  13. After certification of the petition the Civil Registration Officer will contact the applicant to collect the certified petition to change the date of birth in the marriage contract.
  14. The applicant should then forward the certified petition to the Philippine Statistics Authority (PSA) for them to record the change and provide an Annotated Marriage Contract.
  15. The applicant can then collect their Annotated Marriage Contract from the PSA.
  16. The applicant will be contacted through a telephone call or SMS to collect their Marriage Contract when ready.
  17. On the date of collection the applicant will have to produce their proof of identification when collecting their marriage contract.
  18. The whole process takes a period of twenty one days.

Eligibility

The following persons are eligible to file a petition for correction of the marriage contract date:

  • The document owner or any authorized representative
  • The document owner’s spouse
  • Any of the document owner’s children, parents, or grandparents
  • Any of the document owner’s brothers or sisters
  • Any other person duly authorized by law to file the petition on behalf of the document owner



Fees

The city or municipal civil registrar and consul general are authorized to collect reasonable fees for processing the petition. The present rates are:

  • P1,000 – for petitions filed with the local civil registry office
  • $50 – for petitions filed with the Consul General
  • P500 – additional service fee for migrant petitioners
  • If you’re an indigent petitioner, you’re exempted from paying the filing fee.

  • You could correct errors on your marriage certificate by filing a petition for correction of clerical error under Republic Act 9048. This law authorizes the city or municipal civil registrar or consul general to correct typographical or clerical errors in a civil registry document. Before this law was enacted, any changes or corrections in a civil registry document required a judicial order.
  • Mistakes on the date and place of marriage are considered typographical errors. Therefore, you can request corrections by filing a petition for correction of clerical error under RA 9048.

You’re required to present this document if you’re availing of life insurance benefits, claiming a pension, and withdrawing bank deposits. A marriage certificate is also necessary for getting a passport, visa, or work permit if your spouse lives abroad.
