Philippines - Apply for Mineral Processing Permit or License


Procedure

Apply In-Person:

  1. To Apply for Mineral Processing Permit or License, the applicant has to approach the Department of Environment and Natural Resources Mines and Geosciences Bureau (MGB) offices link The applicant has click on the region to find nearby offices.
  2. An application form will be provided to the applicant by the concerned officer. Or the applicant can download the application form from the following link
  3. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
  4. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
  5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
  6. Submit all the documents with the completed form to the concerned officer.
  7. The applicant has to pay the prescribed fee as requested by the authority.
  8. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
  9. All applications are processed within a reasonable time, having regard to the particular circumstances of each application, including the completeness of information and documents submitted to the authority by the applicant.
  10. The authority may seek additional information from an applicant if this is necessary to assess the application. The authority does not need to deal further with an application until the applicant has provided this additional information.
  11. The authority will undergo a thorough inspection by a certified inspector to ensure that it meets the required standards.
  12. After successful verification the authority will issue the permit
  13. This entire process can be completed within 30 days or as per the timeline advised by the respective department authority.





Required Documents

  • Application Form (MGB Form No. 11-02) link
  • SEC-certified Certificate of Registration, Articles of Incorporation
  • Location Map/Sketch Plan (1:50,000 NAMRIA topographic map) of the area of the proposed processing plant
  • Feasibility Study including work programs, plant site, mill and plant layout/design, details of technology to be employed in the proposed operation, anti-pollution devices/measures as well as the plant capacity
  • Certificate of Environmental Management and Community Relations Record (CEMCRR) or Certificate of Exemption (COE)
  • Environmental Compliance Certificate (ECC)
  • Environmental Protection and Enhancement Program (MGB Form 16-2)
  • Social Development and Management Program
  • Proof of technical competence in the form of:
  • Bio-data and track records in mining operations/ environmental management
  • Sworn statement or employment contract/proof of availed service of the technical person/s who will undertake the implementation of the Work Programs
  • Interim Importation Permit/certification from EMB on the use of chemicals (e.g. cyanide, mercury) in compliance with R.A. No. 6969
  • Brief history of applicant’s activities for the last five (5) years, if any
  • Supply Contract/Agreement with mining rights holders, if applicable
  • Proof of financial capability:
  • Latest audited Financial Statements
  • Annual Report for the preceding year
  • Credit Lines/Bank Guarantees/Deposits
  • Proof/s of payment of application fee


B. Additional Requirements after Acceptance of Application

  • MGB reg. Secretary’s Certificate attesting to a Board Resolution authorizing the President to sign and execute documents in connection with the MPP application
  • NCIP Certification Precondition
  • Proof/s of payment of FS Evaluation Fee = PhP20,000
  • Prior approval or endorsement in the form of Resolution or Certification by at least the majority of the Sanggunian concerned

Eligibility

The following Qualified Person may apply for a Mineral Processing Permit:

  • Individual - a Filipino citizen of legal age and with capacity to contract; or
  • Corporation, Partnership, Association or Cooperative - organized or authorized for the purpose of engaging in mining, duly registered in accordance with law, either Filipino or foreign-owned




Fees

The applicant has to pay the prescribed fee of

  • Project cost of > PhP500M = PhP50,000.00
  • Project cost of PhP200-500M = PhP20,000.00
  • Project cost of < PhP200M = PhP10,000.00




Validity

  • The permit is usually granted for a period of five years and can be renewed for another five years.

  • A Mineral Processing Permit (MPP) refers to the permit granted to a Qualified Person for mineral processing. Mineral Processing means the milling, beneficiation, leaching, smelting, cyanidation, calcination or upgrading of ores, minerals, rocks, mill tailings, mine waste and/or other metallurgical by-products or by similar means to convert the same into marketable products.
