Mexico - Obtain a Death Certificate


Procedure

  1. Before human remains can be prepared as desired, a local physician or another person authorized by the Mexican secretary of health must certify the death of the person, determine the causes of his/her death, and issue a preliminary death record (Certificado de Defuncion).
  2. A Civil Registry judge with jurisdiction over the place of death will use this record to issue the official death certificate (Acta de Defuncion) and the required authorization to proceed with burial or cremation.

  • The next of kin must provide documents establishing the identity of both the next of kin and the decedent. Common documents used for this purpose are passports, government-issued photo identification such as a drivers license, birth certificates, and marriage certificates.
  • Cause-of-death information and certification statement
  • Preliminary death record

Instructions

This information is used in the application for insurance benefits, settlement of pension claims, and transfer of title of real and personal property. The certificate is considered to be prima facie evidence of the fact of death. It can therefore be introduced in court as evidence when a question about the death arises.

Need for the Document

The death certificate is the legal record of the fact of death of an individual. As a permanent legal record, the death certificate is extremely important to the decedents family.




Information which might help

If the death occurred outside of a doctors care, family and/or friends close with the deceased must give a statement at the local police station explaining events and attesting to the identity of the deceased person.



Other uses of the Document/Certificate

It is also needed for a variety of medical and health-related research efforts.
Statistical data from death certificates are used to identify public health problems and measure the results of programs established to alleviate these problems. This data is a necessary foundation on which to base effective public health programs. Health departments could not perform their duties without such data.
