Applicants must get a few certificates / Licenses / NOCs before applying for a license or permit for Open Air Theatre are listed below
- A No Objection Certificate (NOC) from the Municipal corporation / Gram Panchayat/ District Council/ Development Authority that has jurisdiction over the area stating that the authority does not have any objection with the construction/commencement of the proposed Open Air Theatre.
- Proper documents supporting the ownership of the building/premises along with the correct measurement of the theatre such as the height of the galleries or tiers, width of the strait ways, number of stairs in each of the straight ways, the width of each corridor, number of gangway or doorways.
- A certificate stating the ownership of the cinematograph apparatus to be used.
- Certificate from the Executive Engineer of the Public Works Department (PWD) of the area stating that theatre is constructed by following the rules relating to the structural features.
- Certificate from the Electricity Department of the State Government stating that the electrical equipment has been installed following the rules and are of the required standards.
- Certificate from the District Officer of the Public Health Department of the State Government stating that arrangements of public sanitation have been made following the sanitation rules.
- Certificates for public exhibition of a film produced in India from the Ministry of Information and Broadcasting, Government of India.
- Certificates for public exhibition of a film imported into India from the Ministry of Information and Broadcasting, Government of India.
- Certificate from the Superintendent of Taxes of the area stating that no amount of tax is due under the Amusement and Betting Tax Act of the state.
- Certificate from the Divisional fire officer of the area stating that proper fire safety measures and norms have been taken while building the theatre. And also that the theatre has proper fire extinguishers installed to control small fires in emergency situations.
Apply In-Person
- Applicants must visit the office of the Deputy Commissioner/ District Collector/District Magistrate to apply for the license or permit for Open Air Theatre: [Refer to Office Location and Contacts Section of the page for contact details.]
- Collect the application form from the concerned authority and fill in all the details.
- The application for Open Air Theatre must be in writing. Therefore, write an application letter addressing to the Deputy Commissioner of the Police and duly sign it.
- Attach the copies of all the above-mentioned documents along with the application form and letter and submit it to the licensing authority.
- Provide all the original documents to the licensing authority for verification.
- After validation of the documents, pay the required application fee to the concerned authority and keep the receipt safe for future requirements.
- Next, wait for the licensing authority to call you for visiting the site for inspection.
- After inspection of the site, if the licensing authority is satisfied that all the rules have been followed and there is no objection from any authorities then the license will be granted.
- The applicant will receive a message/call on the registered phone number to collect the license from the office of the Deputy Commissioner.
Note: The applicant may be asked to show the original documents on the day of inspection.

Eligibility
- Must be 18 years of age.
- Must be the owner of the Theatre.
- In case of a franchise, must fulfil the area, investment, man-power, and brand fee requirement.
Fees
- Details about the application fee for the license/permit of Open Air Theatre shall be provided by the licensing officer.
Validity
- The license/permit for Open Air Theatre is valid for a period of 3 years.

Instructions
Here are some of the instructions to be followed before applying for a license/permit of Open Air Theatre:
- No permanent Open Air Theatre is allowed within a radius of 200 yards from any hospital, educational institution, places of worship, graveyard, cemetery, cremation ground, or other already existing cinema theatres/ multiplexes, an open-air theatre.
- No permanent Open Air Theatre will be allowed to be constructed in any area that may disturb the master plan of an exclusively residential area or a restricted area.
- No permanent Open Air Theatre will be allowed unless it has sufficient space in its compound or in an adjacent area for parking vehicles.
- No permanent Open Air Theatre will be allowed unless it has sufficient space to hold the queues of spectators.
- The queue of spectators or the vehicles coming to the theatre must not obstruct the public road or traffic.
- If the Open Air Theatre is on the rooftop of a building, an open space of 6 meters must be left around the building for providing access to an 18-ton fire engine. The 6 meters area must be free of any obstruction or parking. Also, the building must have a minimum of 5 meters in width and 2.5 meters in height for access to fire fighting vehicles.
- If the Open Air Theatre is on the rooftop of a building, there shall be a minimum of one external Staircase of 1.50 Meters width and one internal staircase of 2.0 Metres width for every 30 Meters of travel distance to provide access to the theatre and such staircases shall be placed at the remote ends from each other
- If the Open Air Theatre is on the rooftop of a building, the exit requirements prescribed under Common Building Rules must be followed.

Need for the Document
- License for Open Air Theatre was made mandatory under the Cinemas (Regulation) Act, 1955 to restrict the public exhibition of cinema by means of a cinematograph in places other than for which license has been granted in order to avoid disturbance to the nearby area and also to be sure of the safety of the people visiting the theatre.
- The license was made compulsory so that the government can control and restrict the exhibition of any obscene or objectionable contents.

- The prescribed precautions have been given importance for the safety of the persons visiting the theatre.
