Kerala - Register a Charity


Procedure

Apply In-Person:

  1. To register a charitable trust, an application for Trust registration must be made to the Deputy Commissioner of the state for charity registration. The address can be found on the giving Contact Link.
  2. The application for charity registration must include details like the charity name, names of Trustees, mode of succession, etc.
  3. The application must involve a court fee stamp of Rs.2 and a nominal charity registration fee, which varies depending on the Trust property and the State of registration.
  4. Apart from this, the applicant has to prepare a “Trust Deed” which is extremely essential as the legal proof of your Trust’s existence. The information related to Trust Deed is mentioned below under the “Required Document” Section.
  5. Submit the Trust Deed, with properly attested photocopies with the local registrar.
  6. Photocopy of the Trust Deed must be signed by the settler on every page.
  7. At the time of registration, the settler & two witnesses must be physically present along with their identity proofs (original as well as self-attested photocopy)
  8. After that, the photocopy and the original registered copy of the Trust Deed will be returned by the Registrar.
  9. The registration fee applicable to register the Trust is charged according to Revenue Tax rules in certain states. It is calculated at the time of the registration only.
  10. The fee has to be paid, via a demand draft, online demand draft, or stamp paper of that particular value, at the time of submission of documents.
  11. The rest of the fee can be paid later at the registrar’s office or to an authorized associate revenue agency after the full value has been calculated.
  12. After submitting all the required documents and completing all formalities it takes a minimum of 7 working days to obtain a registration certificate.



Apply online:

  1. The applicant has to go to the online portal of Kerala to apply for the Society Registration: [1].
  2. If you are a new user, then you need to click on the “New Society Registration” button that is visible on the home page of the portal.
  3. The link will direct you to the registration page where you need to enter the required information.
  4. After filling the registration form, you will receive your password through your registered email address and mobile number. Then click on the “submit“ button.
  5. If once the user registered with the portal user gets a username and password for further login.
  6. After that click on the “submit” button. For New Society Registration, you have to click on the registration button or registration link that is available on the page.
  7. On clicking on the Society Registration link, you will be directed to the registration page.
  8. Now you need to fill in all the relevant information about the newly formed society.
  9. After completing all the mandatory information, then you must click on the “Next” button.
  10. Now you have to add a name, address and designation of the member in the newly formed society using the Add button.
  11. If all member details are added, you have to click on the “next” button.
  12. Then you will be moved to the new online form for entering member’s details.
  13. You have to upload Bye-law and Memorandum of the Society only in PDF format (maximum file size 5 MB).
  14. After uploading the files, you have to click on the “Next” button which will direct you to the payment window.
  15. Once the application is scrutinised, the fee for the society registration will be displayed on the screen.
  16. On using the e-payment facility you can complete the payment process online.
  17. Select the payment mode and then click on the submit button.
  18. On clicking on the submit button, you have completed the registration process.
  19. After completing your application, you will receive a message showing “Your Application Submitted Successfully”.
  20. You can save or print the Acknowledgement slip form for the future reference.
  21. On submission, a confirmation message will be sent via SMS and email.
  22. After the completion of society registration, society will get a registration number and mobile number and email address of the applicant.
  23. If your application is rejected, it will appear on the society account along with the remarks statement. You can view the remarks by clicking on the “view remarks” button.
  24. After rectifying the defect, a firm user can resubmit the application to the office of the society registrar.



Apply through Centres:

  1. To apply through centres, the applicant has to visit the respective “CSC” centre. Please tap on the following link to locate the centre according to the respective district: link.
  2. Make sure to have the documents that are listed under the “Required Documents” section of this page.
  3. It is advised to take the documents in original to the kiosk for scanning purposes.
  4. The operator will process the application online.
  5. On successful submission, the applicant will receive an application number as acknowledgement.
  6. The status, viz. Approval or Rejection if any, will be conveyed to the applicant through an SMS.
  7. If verified, the certificate will be hand delivered or sent through post to the address mentioned while applying in a stipulated period of time.

  • Self-attested copy of PAN and ID proof
  • Proof of registered office address (Electricity Bill/Water bill etc)
  • NOC from the landowner with his identity proof
  • Proof of property registered in the trusted name
  • Certified copy of Trust deed Consent letter of Trustees
  • Court fee stamp of Rs.2 affixed to the application form

    • Minimum and maximum number of trustees
    • Address of the registered office of the trust
    • Purpose of formation of trust
    • Objectives of trust
    • Rules and regulation of trust
    • Information about opening a bank account
    • Tenure of the trustees
    • Designation of trustees if any, responsibilities with compensation for the professional services they are intended to render. The Board of trustees is not entitled to draw remuneration. They can only take compensation for the professional services they are rendering to the trust.
    • Date of execution of the trust deed.
    • Details of the trust fund set up by the settler and the movable and immovable property divested in the trust fund.
    • Details of sources and activities through which income is earned and deposited in the trust fund.
    • Utilization of trust fund for the benefit of beneficiaries of the trust.
    • Right, duties, and limitations of trustees
    • Details regarding number and manner of holding a meeting in a year
    • Procedure to modify or alter any clause in the trust deed
    • Conditions under which a trustee shall cease to exist
