Kenya - Renew Nuts and Oil Produce Manufacturer License


Procedure

Apply In-Person:

  1. Application for a Nuts and Oil Produce Manufacturer license shall be renewable annual and only applicable for the area inspected to the AFA Nuts and Oil Crops Directorate office at the County Government Office, at least thirty (30) days before the expiration of the current license.   2. The application shall be made in writing using a prescribed form; Application For Grant/Renewal Of A Manufacturing license, obtainable AFA Nuts and Oil Crops Directorate office at the County Government Office.
  3. Upon obtaining the application form, the applicant should legibly complete the form in triplicate, attach the relevant supporting documentation as listed under the “Required Documents” section of this page. The complete file should be submitted to the AFA Horticultural Directorate office at the County Government Office.
  4. In addition to the required documents, the Directorate will require the applicant to submit the Quarterly Returns, using a prescribed form also obtainable at either office.
  5. The application shall also be accompanied by an application renewal fee for Kshs 10,000.00, please refer to the “Fees” section of this page for more information.
  6. Upon submission of the application, the receiving officer will check for discrepancies or ineligibility in the application documents. If a discrepancy that cannot be immediately corrected exists in any of the documents, the application and all the submitted documents will be returned to the applicant and should not be re-submitted until the discrepancy has been rectified corrected.
  7. Where all the required information and documents have been submitted for processing, applicants will receive an acknowledgment receipt as proof of submission of the application and for future inquiry.
  8. Upon a successful document evaluation phase which is usually within thirty (30) days. Notice of the decision (Approval, Deferral, or Rejection) for the application will be communicated to the client.
  9. Once the renewal registration processing is done the renewed Nuts and Oil Produce Manufacturing License are posted to field offices for collection by the applicant.


Apply Online Step 1: Register on the AFA IMIS portal (for new applicants)

  1. Applicant should browser the AFA Integrated Management Information System
  2. On the Home page, hover the mouse cursor over the “REGISTER NOW” tab and click on it.
  3. This will facilitate the online registration of AFA IMIS stakeholder system users and organization details, page to open.
  4. Populate all the available fields accurately before clicking on the “Submit Application” tab. Upon successful submission, the applicant will receive a Registration submission notification on their device.
  5. Upon receipt of the registration request, the Agriculture and Food Authority Registration office will start the vetting process to ensure that the applicant is a legitimate company. After approval, the IMIS system will forward an email with the credentials that will be sent to the user's registered email address to facilitate access to the portal.
  6. Once login the applicant will be prompted to change their password.


Step 2: Apply for the Nuts and Oil Produce Manufacturer License Renewal

  1. Once logged in the portal, hover the mouse cursor over the “AFA Main Menu” option, on the expanded menu, select the “Nuts and Oil Directorate” option, then select the “License Renewal” option and then finally select the “Nuts and Oil Manufacturing License Application Renewal” option.
  2. This will facilitate the online license application form to open, Populate all the available fields accurately, provided all required information relevant to the application, upload all the supporting documentation and then check the Accept Terms and Conditions of Use thereafter before clicking on the “Forward for Approval” tab.


Step 3: File Nuts and Oil Crops Manufacturer Monthly Returns

  1. The applicant will be required to file their monthly returns to the board.
  2. Returns can be filed online via the AFA Integrated Management Information System
  3. Once logged in the portal, hover the mouse cursor over the “AFA Main Menu” option, on the expanded menu, select the “Nuts and Oil Crop Directorate” option, then select the “Returns” option then select the “Nuts and Oil Crops Manufacturer Monthly Returns” finally.
  4. Populate all the available fields accurately, upload the requested documents, before clicking on the “Document Submission” tab. Upon successful submission, the applicant will receive a Registration submission notification on their device.


Step 4: Payment for the License fee and issue of the Manufacturer License

  1. Upon successful submission, the applicant will receive an AFA Nuts and Oil Crop Directorate submission notification on their device and will be sent an invoice for the license fee.
  2. The applicant will be required to pay for the annual license fee of Kshs.10, 000.00, the payment should be channelled using the Directorate preferable payment.
  3. Upon making payment, the applicant is required to share the proof of payment (payment details) with the Directorate, applicant will then receive a payment confirmation notification.
  4. After a successful document evaluation phase, which is within 05 working days the applicant will be sent a manufacturer license to print. Applicants should log in to their AFA IMIS account to access the license.


NOTE:
  • All renewal applications will be subjected to an integrity vetting process and any false information provided by the applicants or other integrity issues will lead to prosecution and cancellation of the license.
  • A person who is aggrieved by the decision of the Authority in respect of a grant, refusal, renewal, or variation of a license may appeal to the Cabinet Secretary within 30 days from the date on which the applicant received notice of the decision.

  • Copy of Public Health’s Food Drugs and Chemical Substances License where applicable (Grant/Renewal)

  • Any other requirements that may be prescribed by the Authority from time to time.


Note: In the event of a change in the directorship of a company, updated CR12 and Copies of ID’S or passport & valid work permit shall be submitted to the Directorate

Eligibility

  • Any person, cooperative society, group, or company who intend to erect /operate a processing firm that transforms nuts and oil crops produce/products to various end-use products




Fees

The following fees are applicable:

  • Late Application penalty fees of Ksh.1,000.00 (Non-refundable)
  • Renewal license fees for a manufacturer Kshs.10,000.00.


Payment methods: mobile money platforms

  • For payments made via MPESA.
  • Log in to the System.
  • Go to the 'License Payment & Appeal' menu.
  • Open the 'License Payment' window.
  • Click Pay Now.
  • You will receive an MPESA prompt via the phone number provided during registration.

For payments made via the bank, through direct deposit/RTGS/Cheques, applicants will be required to upload the reference document on the System.


Validity

  • The manufacturer license is valid for one (01) year unless suspended, revoked, or cancelled by the Authority.
  • The license expires on the 30th June of every year and should be renewed, not later than thirty (30) days of the current license. Late application shall attract a penalty fee.

  • Nuts and Oil Crops Directorate is an arm of the Agriculture and Food Authority (AFA) mandated to develop, promote and regulate the nuts and oil crops industry in Kenya. Before the enactment of the AFA Act 2013 and Crops Act 2013, the role of developing, promoting, and regulating the nuts and oil crops subsector was largely amorphous.
  • In here Kenya Coconut Development Authority was tasked with the responsibility of developing, promoting, and regulating the coconut industry while Horticultural Crops Development Authority, among other functions, focused on other horticultural crops including macadamia. The Ministry of Agriculture, Livestock, and Fisheries handled the rest of the nuts and oil crops.
  • Though this set up to some extent exploited the potential in the nuts and oil crops subsector, the desired results were not adequately achieved. It is on this basis that the government initiated reforms in the Agricultural sector that gave rise to AFA and its underlying Directorates.
  • AFA and by extension its Directorates was incepted to spearhead the development of scheduled crops as delineated in the First Schedule of Crops Act 2013. This was envisaged would negate for instance the amorphous way the nuts and oil crops subsector was being developed and regulated.
  • The Nuts and Oil Crops Directorate assumed the mandate of the hitherto Kenya Coconut Development Authority. Other than coconut, this Directorate was added additional nuts and oil crops such as macadamia, cashew nuts, and groundnuts among others.

Need for the Document

  • A Nut and Oil produce manufacturer license authorizes the holder to conduct the business as a manufacturer in nut and oil produce products in Kenya.
  • No person can act, as a nut and oil produce manufacturer unless he is the holder of a current registration certificate and operating license issued in respect thereof by the Board after consultation with the Director.

  • Every manufacturer of nuts and oil crops produce shall file quarterly returns to the relevant County Government and to the Authority not later than the tenth day of the first month after the end of the quarter.
  • Every dealer or manufacturer shall pay a licensing or registration fee as prescribed
  • The Licensing Authority may revoke, suspend or vary a certificate of registration or license or a permit issued to a manufacturer if they–
  • Fail to comply with these regulations or the conditions set out in the certificate of registration or license or permit.
  • Commit an offense under the Act or any other written law in respect of the activity for which they have been registered or licensed or permitted.
  • Every grower, manufacturer, and dealer shall develop, implement and monitor a detailed traceability system to track and trace the history and location at all stages of production, processing, and distribution of the nuts and oil crops produce and products.
  • Every grower, manufacturer, or dealer shall maintain traceability records relating to the product and products for at least two years.
  • Every grower, manufacturer, or dealer shall maintain traceability records relating to the seed and seedlings of nuts and oil crops for at least five years.
