Registration of a pesticide in Kenya follows a near-identical procedure to that of Tanzania and Uganda

Stage 1

An applicant should submit filled form "Form C"to the registrar alongside it an experimental label and copy of a dossier of technical information. technical information must be summarized on the label in conformity to the pest control products labelling, advertising and packing regulations.

Stage 2

The applicant must attach the necessary document on the application form before submission.

Stage 3

If the board is satisfied with the information provided on the application form, the product is released under experimental permit for local biological efficacy trial.

• These Institutions are required to send a confidential report to the board on the efficacy trial findings before a pesticide is registered.

The Board also ensures that the technical information is summarized on the label in conformity to the Pest Control Products, Labeling, Advertising and Packaging Regulations. Every person desiring to register a pest control product is requested to submit:

1. an application for introduction of a new pest control product, Form C,

2. an application for registration form, Form A,

3. an experimental label, Label format,

4. a copy of a dossier of technical information (details of requirements are available at PCPB).

5. a sample of the pest control product, and samples of the technical grade and analytical laboratory standard of the active ingredient.

6. Introductory fee of Ksh 10,000 to obtain an experimental permit

Step 4

The registrar will also require submission of a commercial label reflecting the application rates, timing of application as recommended by the local researcher. Every person desiring to register a pest control product is requested to submit an application for registration of a new pest control product, an experimental label and a copy of a dossier of technical information.

Appointment of local agents Board considers various aspects in order to ensure safety to the public, animals and the environment.

Safety, efficacy, quality and economic value of pest control products in line with the Pest Control Products Registration Regulations LN 46/1984. Technical information is summarized on the label in conformity to the Pest Control Products, Labeling,Advertising and Packaging Regulations.

Step 5

Kenyas pesticide registration committee with members drawn from the Ministry of Health, KARI, Coffee Research Foundation and Kenya Bureau of Standards then makes a recommendation to the board for the registration of a product or rejection of the application. If the Board is satisfied with the information provided,the product is released under experimental permit for local biological efficacy trial.

If the board is satisfied with the safety, efficacy, quality and economic value of the product, it is granted full registration for three years and a certificate of registration is issued. The certificate can be renewed after every two years

Under special circumstances, a product may be granted temporary registration for a period not exceeding 12 months, within which the missing technical information or scientific information should be provided.

Such special circumstances include cases where emergency control of infestations is needed or where an applicant commits to produce additional information.

Stage 6

On completion of the biological efficacy trial, a confidential report is sent to Pesticide Control Product Board.(PCPB)

Submission of a commercial label reflecting the application rates, timing of application as recommended by the local researcher, among other things. If the Board is satisfied with the information provided, the product is released under experimental permit for local biological efficacy trials. This is carried out by institutions/researchers that have been accredited by the Board. The list of accredited institutions/researchers is available at PCPB.

If registration is rejected applicant would be communicated with the reasons in writing.

The Ministry maintains an inventory of all pesticides in order to track the movement and use of pesticides according to each stage of the pesticide life cycle including those consented pesticides under rotterdam convention.

• No person shall import, store,transport or sell any pesticide unless it is packed and labeled in accordance with this proclamation
• No person shall sell or store adulterated pesticide
• No person shall formulate ,manufacture,import ,distribute,export,pack,repack,label,sell,store or use a banned and severely restricted pesticide ( for severely restricted pesticides with out written authorization from the ministry of Agriculture in Kenya.

No person shall import into, or sell in Kenya any pest control product unless that pest control product has been Registered,packaged and labeled in accordance with regulations made under the act of pest control.

Registration and control of Pesticide is an important legal requirement all over the world. Every government has an obligation to ensure the safety of its citizens, animals, plants and the environment.The primary purpose of using pesticides is to control pests in crops and animals in order to reduce yield losses. Not Until 1977, the regulations on pesticides in Kenya were governed by the provisions of the Pesticides Control Act of the East African Community.

Thereafter the regulations were governed under the Pharmacy and Poisons Act, Cap 244.The enactment of the Pest Control products Act in 1982 transferred the legal mandate to the Pest Control Products Board.The Board Mandated to regulate importation,exportation, manufacture, distribution and use of products used for the control of pests in Kenya.

According to Section 4 of Pharmacy and Poisons Act: No person can import into, or sell in Kenya any pest control product unless that pest control product has been Registered,packaged and labeled in accordance with regulations made under the Pharmacy and Poisons Act.

The act defines a Pest Control Product as a product, device, organism, substance or thing that is manufactured, represented, sold or used as a means for directly or indirectly controlling, preventing, destroying, attracting or repelling any pest.
