Kenya - Obtain a Diamond Dealers License (Local Trading)

Apply Online

  1. Individuals intending to deal in diamonds in Kenya can apply for a for a diamond dealers license for local trading in Kenya by making an online application to the Ministry of Mining. This can be done online by visiting the Mining’s Department online portal through the following Mining Cadaster Portal
  2. The first step is to register on the Mining Cadaster Portal through the following link.
  3. The applicant should navigate to the “I wish to make Mineral Dealing licence applications” section and click on the “Register for an account” link to continue with the application.
  4. This will take the applicant to the next page which is the “Registration to use the Online Mining Cadastre” page.
  5. Fill in the required information for registration.
  6. After completing the form, and uploading supporting documentation, accept the terms and conditions by checking the checkbox, and click on the “Register” button to create an account.
  7. The applicant will receive an email to verify their email address, however the account will be restricted until it has been authorized by a Ministry representative.
  8. Once authorized, the applicant will receive another email indicating that the account has been updated, after which the applicant will be able to sign in to the portal.
  9. Log into the “Mining Cadaster Portal” account using the registered Email address and password.
  10. Upon entering the Mining Cadaster Portal select the “License Applications” option on the left pane and click on the “Dealers license/Permit” tab. This will direct the applicant to the “Application for a Dealer’s Licence/Permit” page where they can continue with the application process.
  11. Fill in the required information, upload the required documents and accept the terms and conditions then click on the “Submit” Button to proceed to the next step.
  12. The applicant should then Select the License option and indicate that it is a new application by selecting the “New Application” option.
  13. The applicant should also indicate that it is a Diamond Dealers License application by selecting the “Diamond” option in the minerals category.
  14. Attach required documents to the application. A list of the required documents can be found in the “Required Documents” section of this page.
  15. Upon clicking the “Submit” button, the application will be sent to Ministry for review and verifications to be made. It usually takes a period of two days for verifications to be made.
  16. After successful review an approval email containing payment details will be sent to the email address provided during the application.
  17. Proceed to make the application payment using the instructions provided. The application fees for the license can be found on the “Fees” section of this page.
  18. Once payment has been made select the payment mode, enter the enter the Transaction Ref Code/No and upload proof of payment receipt and click on the “Submit” button.
  19. Upon entering the next page, click on the “Generate Acknowledgement Receipt” button. This will cause a receipt to be generated which the applicant can download and save for reference.
  20. In this page, the applicant can check the application status of their application.
  21. The processing time of the application is usually 30 days.
  22. Once approved, the applicant will be notified via email and SMS. A pdf copy of the license will be availed in their account for download by clicking on the “Generate License” button.


Apply In-Person:

  1. To apply for a diamond dealers license for local trading in Kenya, the applicant has to contact the Department for Mining Offices to make the application.
  2. Here the applicant will be given an application an Application for a Diamond Dealer’s License - Form DDL-1 by a licensing officer to fill and submit.
  3. Fill in the application and attach the required documents. A list of the documents can be found under the Required Documents" section of this page.
  4. Proceed to pay the required application fees and attach the payment receipt to the application document. Details on the application fees to be paid can be found under the "Fees" section of this page.
  5. The applicant is to submit the completed application form, required documents to the Cabinet Secretary of the Department of Mining for verifications to be done.
  6. The licensing officers will review the application regarding any areas of noncompliance with the license requirements which the applicant is required to address. In addition, the officers will conduct an inspection to ensure that the applicant has adequate technical and administrative capacity to carry out the business for which the license is sought.
  7. The reviews, inspections and approval of the application will take approximately a period of 30 days to be completed by the licensing officers.
  8. The Cabinet Secretary shall, notify the applicant of the decision on the application within thirty days of receipt of the application.
  9. After notification to the applicant, the approval for the license will be published in the Kenya Gazette and the local dailies for a period of 45 days. Within this period any individual who opposes the approval may raise the issue with the licensing authority.
  10. The license will be granted to the applicant after 45 days upon publication in Kenya Gazette and local dailies.
  11. The applicant will be notified to collect their license.

  • Duplicate copy of the receipt of the payment of the prescribed fee.
  • Where the applicant is a company a certified copy of the applicant company’s certificate of incorporation, current CR12 and certified copy of its memorandum and articles of association
  • Where the applicant is an individual a certified copy of Kenyan national identity or current passport for non-Kenyans;
  • A statement giving particulars of the financial resources available to the applicant.
  • Letters of appointment of agents detailing their contacts and areas of operations and their identification documents.

Validity

  • A diamonds dealer’s licence shall expire on the thirty-first day of December of the year in which it is issued.

Instructions

  • An application for the grant of a diamond dealer’s licence shall be made by completing Form DDL-1.
  • An applicant shall be required to re-submit an application if it is incomplete or inaccurate.
  • The applicant shall maintain a valid e-mail address for official communications with the Mining Cadastre Office.
  • An application shall only be accepted upon payment of the prescribed application fee.
  • The submission of any document or the making of any statement which is found to be false shall render the application null and void.
  • Where it emerges at a later stage that a false statement was made during the application, the licence shall be revoked.
  • An applicant may withdraw an application before the licence is granted.
  • An application fee once paid is not refundable.
  • The Cabinet Secretary shall, make a decision and notify the applicant of the decision on the application within thirty days of receipt of the application.
  • A diamond dealer's licence shall be issued digitally together with a paper copy using Form DDL-2.

  • in relation to the export of rough diamonds from Kenya, the certificate issued by the Cabinet Secretary or a person authorised by the Cabinet Secretary for the export of rough diamonds from this country.
  • in relation to the import of rough diamonds, a similar Kimberley Certificate issued by the respective authority of the exporting country for the export of rough diamonds.
