Kentucky - Obtain a Marriage License


Procedure

  1. Go to the County Clerk's Office where you plan to file.
  2. Present and submit required documents.
  3. Complete the application form.
  4. Pay the marriage license fee.





Required Documents

  • Both applicants must present an acceptable form of ID, such as a drivers's license, government issued picture ID, passport, and applicants must also present their social security cards.
  • Persons Getting Married who are Under age 18: Provide proper identification and birth certificate. Get the Consent to Marriage Form signed by your parent or legal guardian. Parents or legal guardians must provide two witnesses over the age of 18 whom they have known for 5 years or longer.
  • Marriages of Pregnant Women Under age 18: Either the male or female, under the age of eighteen, may apply to a district court judge for permission to marry.

Eligibility

  • Both applicants must be 18 years of age or older.
  • For one or both applicants who are 16 and 17 years old, parental consent is required and the issuance of the license must be in the county of the under aged applicant.
  • A 16 year old applicant is not allowed to be issued a license unless they are pregnant and have a District Court Judge issue a court order directing the Clerk to do so.


Prohibited and Restricted Marriages:

  • Marriages between persons who are nearer of kin to each other by blood, than second cousins.
  • Marriages between first cousins.
  • Marriages with a person mentally incompetent.
  • Marriages where there is a husband or wife living, from whom the person marrying has not been divorced.
  • Marriages not solemnized or contracted in the presence of an authorized person or society.
  • Same sex marriages.
  • Common law marriages.
  • Proxy marriages.


Note: Kentucky does not marry minors whose parents reside outside the Commonwealth of Kentucky




Fees

Marriage license application fee in Kentucky is $35.50 - $38.50. Fee may vary from county to county.




Validity

Marriage licenses are valid for 30 days, including the date it is issued, and after that time it is invalid. Therefore, if the marriage is not solemnized within the 30-day period, the parties must apply for a new license.

It can be used in any Kentucky county and cannot be used anywhere but in Kentucky.

The bride and groom may go to any county in Kentucky to get a marriage license as long as both are 18 years of age or older.

Both the bride and groom must apply in person at the county clerk's office.

  • Mothers first & maiden name
  • Current status of bride & groom (Single, Divorced, Annulled, Widowed)

  • Race of bride & groom
  • Whether bride & groom are related (First & second cousins are not permitted to marry in Kentucky)
  • Date of marriage
