Jamaica - Replace a Lost Land Title


Procedure

Apply In-Person

  1. In order to apply for duplicate land title in case the original title is lost, you should make an application to the Registrar of Titles under the National Land Agency (NLA) to have the land to obtain a new. Please view the NLA office location map and contact details via this link: Link
  2. Obtain the application form for requesting for a duplicate certificate for the NLA office or download it for their website through this link: Link you can also download the form directly via this link: Link (word Doc)
  3. Read the instructions provided in the application form and fill and sign the form under the witnessing of a Justices of the Peace (JP) or by a Notary Public. Note that if the form is completed before a Notary Public in a Foreign State or Country then a Certificate from the relevant body appointing notaries public should be produced verifying the commission of the notary public
  4. You can also seek the help of an attorney to assist in preparing a statutory declaration which must include all the details provided in the “Institutions” section below
  5. Submit the complete application alongside all the required documents to the registrar of titles at the NLA office
  6. The registrar will verify your application and may ask you to provide more evidence to support your application and upon a satisfactory validation of the application, the registrar will approve your application
  7. Once approved you will be directed to advertise the notice of the application in a local newspaper. The advertisement should be published twice in a daily newspaper to serves as a notice to the world and the public and if you live abroad, if the applicant resides overseas, the registrar will also likely require that you advertise in a foreign newspaper relevant for your address. This is down for any person who may oppose the application to rise their case to the registrar
  8. If there are no complaints regarding the application 14 days after the second publication, submit the prove of advertisement to the registrar by providing the entire page of the newspaper on which the notice appeared to including the date of the publication
  9. And pay the standard application fee of $100 and obtain the payment receipt
  10. If the registrar finds no evidence or reason opposing the application, the registrar will cancel the lost title and provide you with a new one

  • Due to the complexity of this process, it is recommended that you use the help of a registered attorney to assist you with this application

  • where the Title was kept
  • by whom was the title kept
  • when and where the Title was last seen
  • the searches that you have made to locate the Title
  • the value of the property
  • any loan or mortgage on the property
