Italy - Obtain a Pending Charges Certificate


Procedure

Apply to either:

Provincial criminal records office (Casellario giudiziale)

Solicitor General's office (Procura), in person or through an authorised friend or relative in Italy or through the nearest Italian diplomatic/consular authority at place of residence.

Application must be signed by the person whose certificate is requested and indicate the type of certificate being requested as Pending Charges.

Eligibility

This certificate can be requested ONLY by a person who resides or has resided in Italy for at least 6 months duly registered at an Italian town hall. It is necessary to declare the exact period and the complete address of residency.



Fees

  • 3.84 for diritti di certificato [certificate fee]; and
  • 16.00 for bollo [stamp duty]

Certificates to be issued on the same day of the request require the additional payment of:

  • 3.84 for diritto d'urgenza [urgency fee]

Validity

The Pending Charges Certificate has a 6-months-validity.

The Prosecutors Office of the Court is responsible for the issue of such certificates in Italy.

Unlike the General and the Criminal Records Certificates which can be requested by any Italian or a Foreigner at any Court in Italy, the Pending Charges Certificate can only be applied for at the Court of the place where the applicant officially resides.

Need for the Document

Pending Charges Certificate attests the existence (or nonexistence) of any criminal pending proceeding which has not been defined yet through an irrevocable action of a Judge.

It certifies the presence of outstanding criminal proceedings involving the person owner of the certificate.

When applying by post, remember that some Procura might ask for additional requirements therefore it is advisable to contact the Procura in Italy before posting your request.

Should the certificates need to be submitted to Foreign Authorities, they will need to be legalized by the same authority and at the same office, according to the country of destination of the document.
