FOR MARRIAGE WITH ITALIAN CITIZEN (ARTICLE 5 OF THE LAW 91/92 AND AMENDED)

Citizenship, in accordance with Article 5 of Law February 5, 1992 no. 91 and subsequent amendments and additions may be granted by marriage, in the presence of the following requirements:

• The applicant, a foreign national or stateless person, to be married to an Italian citizen and reside legally in Italy for at least 2 years after the marriage
• If the spouses reside abroad, the application may be made after three years from the date of marriage

These terms are reduced by half in the presence of children born or adopted by the spouses.

At the time the decree granting citizenship should not be intervened dissolution, annulment or termination of the civil effects of marriage and there must be separation of the spouses.

FOR RESIDENCE IN ITALY

Citizenship within the meaning of 'art article. 9 of Law 91 of 5 February 1992 and subsequent amendments and additions, may be granted:

• The foreigner whose father or mother or one of the direct ancestors of the second degree were citizens by birth or was born in the territory of the Republic and, in both cases, there is a legal resident for at least three years (art. 9 , c.1 letter a)
• At the foreigner adopted by an Italian citizen lawfully resident in Italian territory at least five years after adoption (Article 9, c.1, letter. B)
• The foreigner who has served, even abroad, for at least five years in the employ of the Italian State (Article 9 c.1, letter c)
• A national of an EU Member State if legally resident for at least four years in the Italian territory (Article 9 c.1, lett.d)

• The foreigner residing legally for at least 10 years in the Italian territory (Article 9 c.1, lett.f)

• belonging to the Italian group;

How to obtain Italian citizenship is defined under Italian Nationality Law, as controlled and regulated by the Ministry of the Interior of Italy. Italy, like many other European countries, prefers ancestry-based citizenship, the "right of blood" (or "jus sanguinis"), as opposed to birthplace-based citizenship, the "right of soil" (or "jus soli"), when admitting new citizens. There are multiple conditions by which you may seek, apply for, and be granted citizenship in Italy. If you fulfill any of these conditions then you may apply to begin the process of applying to be a citizen. The Citizenship Certificate attests the Italian citizenship of a person. It demonstrates the Italian citizenship and can therefore only be issued to persons resident in Italy. It contains the personal data (name, surname, date and place of birth) and the specification of citizenship.

If your parents (rather than your grandparents) are Italian citizens, you are entitled to citizenship yourself through the jus sanguinis principle. This is an automatic adjudication of citizenship and requires little paperwork. On the other hand, citizenship is not automatic for children born in Italy, unless both their parents are Italian. Children of foreign-born people who don't have the Italian citizenship themselves can only be granted citizenship after three years of residency in the country.
