Guatemala - Register a Marriage


Procedure

Notarized Marriage Certificate by the Church Minister

  1. The notary must file for registration purposes, the circumstantial notice of marriage in the Civil Registry of the municipal district in which it is held within a period not exceeding 30 days.
  2. The notice must indicate if there is a prenuptial agreement.
  3. Registration must be done within the period prescribed by law.


Municipal Marriage Registration

  1. Requirements should be submitted in original and photocopied form. The names of the parties, the marriage certificate number and date of wedding celebration must also be submitted.


Late Registration of Notarized Marriage Certificate issued by the Church Minister

  1. Obtain and submit all necessary document for the registration process.


Consular Marriage Certificate through the Ministry of Foreign Affairs

  1. Inform the Consulate or Diplomatic Mission of Guatemala in the country or state where the marriage was held about the ceremony.
  2. The Ministry of Foreign Affairs through the Directorate of Consular Affairs, should be referred to the Civil Registry.
  3. The application for registration of marriage consular must have the signatures of the parties and the Consul officer.
  4. The procedure will be based solely on the Civil Registry registering the marriage via the form sent by the Ministry of Foreign Affairs.


Consular Marriage Registration via Notary

  1. The procedure will be based solely on the Civil Registry registering the marriage.
  2. Consular marriage celebrated by a Guatemalan notary, registration does not need passes law, unlike the consular marriage celebrated by a foreign notary.





Required Documents

Marriage Between Minors

  • Birth certificate of the minor
  • Personal Identification Document or identity card of the parents
  • Circumstantial notice, the notary shall state that parents appeared, who authorized the marriage.


Notarized Marriage Certificate issued by the Church Minister

  • Circumstantial notice of marriage in original and duplicate.
  • The notice must indicate if there is a prenuptial agreement, identify supporting documents
  • In case of marriage between minors, must indicate the type of authorization obtained for the celebration of the act.


Municipal Marriage Registration

  • Circumstantial Notice of Marriage Municipal Officer
  • Certified copy of Marriage


Late Registration of Notarized Marriage Certificate issued by the Church Minister any of the following documents:

  • Administrative Affidavit
  • Photocopy of circumstantial notice issued by the competent authority for marriage
  • Proof of Marriage, issued by the competent authority
  • Circumstantial notice issued by Notary
  • Photocopy of the identity card, which will indicate the name of the spouse in the personal data section or as amended
  • Photocopy Neigbourhood Certificate annotated stating the marriage and spouse's name
  • Proof of Marriage, authorized by minister of any religion that is licensed to do so
  • Any other proof of the marriage


Consular Marriage Certificate through the Ministry of Foreign Affairs

  • Consular Services Forms submitted by the Ministry of Foreign Affairs.
  • Other documents that may be required by the consulate (in original and duplicate form)


Consular Marriage Registration via Notary

  • Protocolacin Testimony Act of marriage celebrated abroad, in original and duplicate.
  • Duplicate duly numbered, signed and sealed
