Ghana - Obtain a Pollution Control Licence


Procedure

Apply In-Person:

  1. Application form for Pollution Control Licence is available in Accra Environmental Protection Agency (EPA) office Contact link
  2. An applicant has to approach the EPA office and applicant can get their application form for environmental assessment permit for large scale and significant impact.
  3. Applicant has to enter all the information in the application form.
  4. The applicant has to make sure that he or she has all the required documents that are required for this process to be successful and they can be found under the "Required Documents" section of this page.
  5. Payment of appropriate fees should be made and that can be found under the "Fees" section of this page.
  6. Complete and submit the application form that is obtained from the EPA office along with the required documents that are listed under the Required Documents section of this page.
  7. Licensing officer arranges with the applicant on when inspection is to take place and about inspection checklist. Inspections are done on Monday to Friday, 8:00am-5:00pm (excluding weekends and public holidays).
  8. On the date of inspection, licensing officer inspects the pollute land, water or air in excess of the standards or guidelines prescribed or issued according to the inspection checklist.
  9. If the pollute land, water or air does not meet the licensing requirements, automatically it fails the inspection hence the applicant is liable to arrange for another inspection.
  10. Re-inspection follows the same procedure as the first inspection.
  11. Only proceed to the next stage of the process after the pollute land, water or air passes inspection.
  12. Licensing process continues to the next step, where licensing officer processes the application form.
  13. Upon approval by the senior officer the license can be taken to the Environmental monitoring committee for authorization.
  14. Generally, the processing time for this procedure is taken 1 month.

  • Site plan duly signed by a licensed surveyor
  • Report on an environmental and social impact assessment.
  • Document on an emergency preparedness and response system designed to prevent, detect, stop, remove or limit the impact of the pollution.
  • A contingency plan on pollution.
  • An addendum to the EIA report.
  • Site location map/Google map of the project area also showing the surrounding environs.
  • An Environmental Impact Assessment Report.
  • A Health Inspection Report, from the City, town or district Council within which the pollution envisaged.
  • Certified copies of identity card.
  • Commitment letter for waste collection.
  • Report & Measures to prevent the pollution from occurring.
  • Report on best available techniques and best environmental practices to control Pollution.
  • Other document attached (where applicable)

Instructions

  • A person who pollutes the environment contrary to the Environment Act or any other applicable law is strictly liable for any damage caused to human health or the environment, regardless of fault.
  • A person who does an act or makes an omission that may aggravate the damage or nuisance caused by earlier pollution is equally and jointly responsible for the pollution.
  • A person shall not carry out an activity likely to pollute the air, water or land in excess of any standards or guidelines prescribed or issued under Pollution Act except under and in accordance with pollution control Licence.
  • A person contributing the greater amount of pollution shall bear the largest burden in paying for cleaning the environment.

Need for the Document

  • Any industry, which discharges sewage or effluent into the environment or emits any pollutant in the air, has to obtain the consent of the State Pollution Control Board in the form of a Pollution Control Board certificate.

  • Applicant should follow all instructions provided by concerned authorities properly.
  • Applicant should provide genuine information while applying for this procedure.
