Ghana - How to File for Divorce


Procedure

Apply In-Person:

  1. To apply for file for Divorce, the applicant must go to the Register General Department.
  2. Address and contact details can be found in the following Contact link
  3. Information related to the AMA office and the License authority can be obtained from the “Office locations and contacts” section of this page.
  4. Applicant must obtain the application form from the relevant department.
  5. Applicant has to enter all the information in the application form.
  6. The applicant has to make sure that he or she has all the required documents that are required for this process to be successful and they can be found under the "Required Documents" section of this page.
  7. A fee for this procedure has to be paid as per the authority’s request.
  8. There are two ways a Divorce can be granted: 1. Divorce by Mutual Consent. 2. Contested Divorce.
  9. Now the lawyer files a petition in the concerned court of the applicant’s district.
  10. Refer the location of court in the “Office location & contacts” section below.
  11. After some period, the court calls for hearing. Make sure that the applicant has met all the requirements for completing the hearing.
  12. The applicant will be notified of the date and time of the applicant’s court hearing by mail/post.
  13. At the time of hearing, the petitioner has to prove that they are not together for more than one year.
  14. Once the hearing is over, the court gives a period of 6 months to re-consider their decision.
  15. In case the petitioner does not withdraw the petition, the judge will grant the applicant’s divorce and set the terms.
  16. The full agreement between the applicant and the applicant’s spouse will be “ordered” by the judge in a divorce decree.
  17. Make sure that the applicant’s get a certified copy of your divorce decree.
  18. The processing time for this procedure takes 15 days.

  • Address proof (Voter ID, Driving License etc.) of parents as per requirement
  • Address proof of wife
  • Marriage certificate
  • Four passport size photographs of marriage of husband and wife
  • Evidence proving spouses are living separately since more than a year
  • Evidence relating to the failed attempts of reconciliation
  • Residential Proof.
  • Ghana card of the applicant.

Fees

  • A fee for this procedure has to be paid as per the authority’s request.
  • Government fees for filing Divorce can be paid as per the court fee for the category as advised by the court clerks / lawyers.
  • A Lawyer’s fee depends upon his experience.
  • A lawyer’s fee depends on the financial status of the party fighting the case.




Validity

  • Validity is proved once the court grants divorce.
  • The marriage is dissolved and the need of the process is accomplished.

  • When a married couple wanted to get separated legally from their current married wedlock relationship due to difference of opinion, quarrel and any other reason, they need to file for Divorce.

Divorce by Mutual Consent:

  • This method of divorce is where both husband and wife jointly file petition for divorce.
  • A joint divorce petition is filed by the divorcing couples in the court through a layer.
  • They can hire a lawyer and provide him with all the relevant details.
  • Lawyer will file a petition in court.
  • The court will send a copy of the petition to the couple.
  • The terms and conditions of such a divorce are reached through an amicable consensus.


Contested Divorce:

  • Hire a lawyer and provide him with all the relevant details.
  • Lawyer files a petition in court.
  • The court will send a copy of the petition to the applicant’s spouse.
  • The spouse could contest or agree to the divorce. If he/she contests it, then the length of the process would depend on the facts of the case.
  • In case of mutual consent the spouses need to prove that they have been staying apart for more than a year.
  • Once the proceedings are over the court gives a period of six months to reconsider the decision to divorce.
  • In case the petitioners don't withdraw the petition the court grants the decree to divorce.
