Cape Verde - Apply for a Divorce


Procedure

  • Gather all required documents.
  • Depending on whether getting a divorce is a mutual decision by the spouses, or a party is against the idea of a divorce, your application will be filed at the municipal hall (for joint agreement) or through the court (litigation). Local numbers you can use to inquire about divorce proceedings
  • Submit all necessary documents and pay the initial fee.
  • Once the proceedings are over and a decision has been issued, you will be asked to pay the final cost of the divorce procedure.

  • Birth Certificate of children
  • Certificate of goods or Negative Certification of goods passed by the City Council or office;
  • Agreement regulating the exercise of parental responsibility
  • Financial agreement
  • According asset sharing


Divorce through court proceedings (litigation)

Divorce by Mutual Agreement (joint agreement): Approximately 69000 ECV

Divorce through court proceedings (litigation): Approximately 138000 ECV


Note: You will be asked to pay an initial amount, whose value varies. The final cost to be paid may also vary after the proceedings.

You may file for a divorce by way of mutual agreement (joint agreement) or through court proceedings (litigation).

Divorce by mutual consent can be applied for by both spouses willingly to competent authorities, usually in the municipal hall. The couple do not need to state the reasons why they are getting a divorce, their intention to dissolve the marriage is enough.

A contested divorce may be sought in court by one spouse against the other and need to have grounds.

In Divorce Litigation, an attempt to reconcile the parties or for them to reach an agreement is always employed. Divorce proceedings in this situation are conducted in courts.
