• The applicant shall submit an application form together with the required documents to any of the regional divisions of Agency "Customs".
• Based on the application and the documents attached the director of "Customs" within 14 days of receipt of the documents and respectively of the removal of inconsistencies, shall issue a certificate of registration of an independent small brewery or refuse to issue such with a reasoned decision.
• If the Director fails to announce his decision in the specified period this shall be deemed as a refusal of registration.

• Application form;
• Certificate of good standing when the company is not re-registered under the rules of the Commercial Register;
• Information produced beer in the previous year, stating: trade name of the product, degree plateau quantity (hl);
• Declaration by the company in connection with the requirements for legally and economically independent brewery which explicitly declare the fact to implement a joint activity with other small breweries;
• In those cases when two or more small breweries cooperate - an agreement for the distribution of total annual production of the independent small brewery;

Independent small brewery" may be legally and economically independent if it meets the following requirements:

• No other company that produces or trade in beer products has shares in its capital or it does not participate in the capital of another company, producing or trading beer.
• There are no individuals( or their relatives)in the management or supervisory bodies who are involved in the management or supervisory bodies of another company producing and trading beer.

For the service in question no fees are collected.

The certificate for registration of independent small brewery is terminated:

• upon written request by the registered person;
• If until 31 January is not submitted to the competent customs office at the location of the warehouse information about the produced beer in the previous year;
• upon termination of the license for warehouse management;
• when the independent small brewery no longer meets the requirements for issuance of a certificate of registration of an independent small brewery;
• when the registered person fails to notify a change in circumstances under which the certificate was issued in the specified terms.

Competent authority:

• Competent authority for issuing the certificate of registration of independent small brewery is the Director of Agency "Customs".

The application for registration of independent small brewery must contain the following information:

• Full name of the applicant;
• Company name;
• Location of headquarters;
• Company's tax number;
• Contact person-position;
• Email,phone number,website,fax number;
• Address of the warehouse/facility;
• Trade name of the product;
• Date of the application;

"Independent small brewery" is a warehouse which is legally and economically independent of any other brewery which does not use in any form premises or production facilities of another brewery and which not operate under a licensing agreement for the production of beer or other malt products and its annual production does not exceed 200 000 liters of beer.

• Persons holding a certificate of registration of an independent small brewery are obliged to keep records that allow the identification and tracking of received, produced, stored, used and implemented excise goods.
• A beer producer that is found to misreport information in the current or previous year,is not considered an independent small brewery.

When two or more small breweries cooperate, and their combined annual production does not exceed 200 000 hectoliters such breweries are considered an independent small brewery.
