Botswana - Registration or Cancellation of a Mortgage Bond

How to Apply:

  1. You should contact and visit one of the two Deeds Registry offices near you for more information on how to file the application (check below under office and contact).
  2. Visit the above office with all the required documents and verbally request for assistance at the service desk on how to file the application.
  3. Submit the documents for verification and processing.
  4. If the registry is satisfied that all the documents are in order, he or she will then outline your application details on the register book immediately any you will be given further instruction.

Note:
Application are filed from 07:30 am to 09:00am each day at the deeds office



Required Documents

  • Draft of the mortgage bond to which the property is being registered or cancelled as security.
  • Copy of the title deed to the property.
  • Documentation of the Registered mortgage bond to be cancelled:
    • Title deed of the property.
    • Consent to cancellation prepared by conveyancer (An attorney admitted as a conveyancer by courts of law) of the execution of registration or cancellation of property to mortgage bond.
    • A resolution where necessary.

Eligibility

  • Any registered holder of a title deed over a property may register or cancel a registration of a mortgage bond.

Fees

  • There is no administrative charge for this service. Conveyancer’s fees or other costs may apply.

Validity

If all documents are submitted at the time of registration, the process should take approximately five working days.

  • The holder of a title deed to a property may register a mortgage bond over the property as security for a debt / loan or may cancel a registration of such a security.
