1. To apply for a Labour Exemption Certificates for Permanent Residents, eligible applicants should visit the Department of Immigration and Citizenship head office housed at the Ministry of Nationality, Immigration, and Gender Affairs or Regional/District Immigration office. 2. Submit the supporting documents to the unit concerned at the Immigration and Citizenship offices, the receiving officer will then verify that all the necessary documentation has been provided and that the applications comply with the selection criteria before issuing the applicant the following Application Forms (Form 4, Form II/Form 8, Form 13 and Form 14 for directors) Forms are not available online and are issued for free at any of the Department of Immigration and Citizenship offices.
3. The completed forms with the attachments should be submitted to the Immigration Office, unit concerned to be verified. If everything is in order you will be required to pay the application fee at the cash counter.
4. The application file will be registered and recorded and applicants will be issued with an acknowledgment letter/waiting card as proof of submission of the application.
5. The Application file shall then be submitted to the Commissioner of Labour for presentation to the Regional Immigrants Selection Board for evaluation, processing, and recommendation.
6. After completion of the processing period, which is approximately 60 days, the applicants will be notified of the outcome of the application in writing.
7. Where the Regional Immigrants Selection Board refuses to issue the certificate, it shall notify the applicants in writing of the refusal and the grounds thereof, an appeal shall then be made to the National Immigrants Selection Board by the aggrieved applicant.
8. If successful the labour certificate of exemption will draw up in such a manner as directed and approved by the commissioner of labour, sign, and stamp, and returned to the immigration office where the application was filed, for issuing to the applicant against their identification document and approval letter.

• Two copies of certified passport
• If married, include one copy of the certified marriage certificate
• Three recent passport-size (30 x 40mm) photographs clearly and correctly depicting an applicant’s features (photographs to be taken at the time the application is made) One photograph to be certified on the reverse side by a Commissioner of Oaths;
• List of employees and their contact details. Attach certified copies of national identity documents (Omang) for citizens and certified copies of work and residence permits for non-citizens
• Copies of supporting documents from professional/regulatory bodies certified by issuing office
• Wages sheet for employees
• Certificate copy of the Valuation of shares
• Copy of certificate of incorporation certified by the issuing authority
• Copy of share certificate for all directors certified by issuing office
• Certificated copies of Form 2/Form 8, 13 and 14 for all directors
• Certified Copies of current bank statements (last three months) certified by issuing office
• Certified Copy of proof of investment certified by issuing office
• Company profile
• Certified Copy of trading license of an existing company in case of variation certified by issuing office
• Certified copies of the list of company assets valued by authorized valuers (attach certified copies of registration books for vehicles)
• Certified copy of title deed/lease agreement/proof of place of operation

The Labour Exemption Certificate is issued to non-citizen Directors who hold a Permanent Residence Permit enabling them to work or operate a business in Botswana and exempting them from holding a work permit.
