- The application to Claim MVA Fund for Medical Assistance shall be made to the MVA Fund office locate country-wide within two to three years of the date of the accident. MVA Fund Contact Details
- Applicants (Claimants) are required to collect the following forms, Claim Form-B and Medical form B1, obtainable at any of the MVA Fund offices, all major police stations, hospitals, and selected post offices or download it via the MVA Fund website,MVA Fund Downloadable, or directly download them using these linksMVA Fund Claim Form BMVA Fund Medical Form To be completed and certified by the doctor who first treated the claimant.
- Submit the duly completed forms attached to the supporting documentation as mentioned under the “Required Documents” of this page to the nearest MVA Fund Office, Customer service desk. Any omission of these documents will render the Application process incomplete.
- Upon submission, the application is checked for completeness and correctness by the Customer Service Officers, and a letter acknowledging receipt of the claim is dispatched to claimants also notifying them of their claim number.
- The application file is then forwarded to a Claim Assessors for assessment and processing as the Claim Assessors may deem fit, i.e.,
- Send the file to the Fund Investigations Department to collect more evidence, or
- Ask the Claimant to provide more information, in such a case, the information must be submitted within the stipulated time from the date of notification. Where the claimant fails to submit the required information, the claim shall be rejected.
- Arrange for the claimant to be examined by relevant medical experts.
- If all the information provided has been ascertained, the Claim Assessors will first determine if the Fund is liable.
- Where the Fund is not liable, a letter of repudiation is sent to the claimant.
- If the Fund is liable, the amount of compensation is then determined, taking into consideration the extent to which the claimant has contributed to the occurrence of the accident. An offer is then made and dispatched to the claimant.
- The claimant then indicates his/her acceptance in writing and upon receipt of such written acceptance, the MVA Fund issues a crossed cheque in favour of the claimant and dispatches it to the claimant by registered mail.
- If the claimant disputes the repudiation or amount of the compensation, he/she should first engage in a dialogue with the MVA Fund substantiating his/her objection. Where the claimant is still dissatisfied after the dialogue he/she may approach the courts for redress of his complaint.
Note:
- All claims and resultant offers or repudiations are assessed and signed by two Claim assessors, one junior and one senior. This is in order to ensure a fair and equitable assessment of claims and to prevent corruption.

- Documents to prove loss of earnings e.g. salary advice slip/letter from employer, tax returns.
- Proof of guardianship of minor children
- Proof of curatorship of adults with diminished mental capacity.
- Copy of identity document
- Copy of medical aid card if under medical aid
- Proof of Residence/Work Permit for foreigners
- Birth certificate if it’s a minor injured (under 21yrs)
- Valid Work/ residence permit in case of foreigner.
- Receipts proving expenses on medical interventions e.g. medical bills (must be costs incurred in the treatment of the injury sustain pursuant to the accident)

Eligibility
The following persons are eligible to apply:
- The claimant himself, personally, if he is an adult with full mental capacity.
- The claimant’s parents or guardians, if the claimant is a minor.
- The claimant’s curator if the claimant is an adult without full mental capacity.
- A claimant, through a representative, can either be a lawyer or a representative or employee of the Botswana government.

Processing Time
- Funeral Assistance Funeral claims will be processed within 8 hours if all claim requirements are in order.
- Medical Assistance Emergency medical assistance will be provided within 1 hour of notification. Non-medical claims will be completed within five days of lodging.
- Loss of Earnings/Income Claims processing will be completed within six weeks of receipt.
- Loss of Support Claims processing will be completed within two months from the date of receipt/lodging.
- Response Time We will respond to your approach or query within two working days.
- Payments Compensation offers will be paid within two days of receipt of acceptance by the claimant.
- Rehabilitation MVA Fund offers three types of rehabilitation to those affected by road crashes:
- Social Rehabilitation – includes compensation for loss of income, modification and adaptation to work environment.
- Vocational Rehabilitation – medical, psychological, social and occupational therapy activities aimed at restoring to health injured patients who have work experience, to enable them to return to the labor market.
- Medical Rehabilitation – medical care and treatment aimed at restoring or developing the functional and psychological abilities of the individual, and if necessary his/her compensatory mechanisms, so as to be as independent and active as possible with the support and education of care givers.
- Welfare claimants for loss of support must ensure that the Fund is informed of any changes in status regarding their lives or the guardianship of minor children.

Instructions
Limitations
- A compensation claim is limited to 1 Million Pula per Claimant. A negligent party (ies) claim is limited to P 300,000.00 for medical and rehabilitation. A computation for a claim for Loss of Earnings or Loss of Support shall be limited to a maximum monthly income of P 6,000.00.
- Medical and rehabilitation compensation for visitors to Botswana shall only be availed whilst one is within the country. Loss of Earnings and Loss of Support is not payable to visitors or their dependents.
- The Fund does not cover for shock or other nervous or physical trauma induced in any person who witnesses, hears, or becomes aware of a road crash. Also, the Fund does not cover for loss of business profits or investment, replacement of staff.
- The Fund will also not compensate for a fraudulent claim. Where a road crash occurs in a restricted area e.g. aerodrome, mining area, etc, the Fund shall not compensate.

Need for the Document
- The MVA Fund compensates any person who is injured or dependants on those killed in a road crash irrespective of whether or not the driver was at fault. The Fund compensates only for Medical Expenses and Rehabilitation, Funeral Expenses, Loss of Earnings, Loss of Support, and Incidental Expenses.
