Apply In-Person

1. You should contact and visit any of the Registrar of Companies and Intellectual Property (ROCIP) offices near you for more information on how to file the application with the office.
2. Accurately fill in the application form which can be obtain from the ROCIP offices or download it by clicking the below link link
3. The complete form and the cover letter requesting for registration of the industrial design should be physically submitted along with the application fees.
4. Your application will be verified if all the documents are in order,if any document is missing, you will be notified by mail and you have two months to submit the requested documents.
5. If the authorized officer is satisfied that all the documents are in order, you will be notified to pay a registration and publication fee.
6. After payment is received, the design will be registered and a registration certificate will be issued.
7. The design will then be published in the Trademarks, Patents and Industrial Designs Journal published by the office. The public can notify the office if there is a similar design already registered.

• Certified copy of passport for non-citizens.
• Covering letter requesting for registration of the industrial design ((The covering letter should include the title and the use of the design)

An application fee of BWP40.00 (individuals and small companies) and BWP80.00 (large companies). Registration and publication fee of BWP75.00 (individuals and small companies) and BWP150.00 (large companies).

5 years from date of filing for two consecutive periods (i.e. Five-year and ten-year anniversaries).

• Industrial design refers to the ornamental or aesthetic appearance of an article or product. Industrial design uses decoration, lines, contours, colours, shape, texture and materials to cover the outward appearance of a product while improving the aesthetics and functionality of the product. If a company has a unique industrial design, it may be interested in registering the design to prevent others from copying the design, thus protecting their product's visual appearance and functionality.
• To be registered, the design must be new, original, and not similar to an existing design. The design must be distinguishable from prior designs.

Registration of industrial design by companies through the Ministry of Trade and Industry is to ensure that the design doesn’t already exist in the market and prevent others from copying your design, thus protecting your product's visual appearance and functionality.
