Preparing for the adoption

Adopting in Belgium

• At the end of the judicial procedure, the clerk of the court invites the competent municipal administration to transcribe the device in registers of births, deaths and marriages. Then, the adoption will be annotated in the population register.

Adopting Abroad

• The foreign file must be subjected to the appreciation of the federal central authority, so that a 'certificate of recording of a foreign decision for adoption' can be obtained.
• The adopting parents must present the foreign file and the certificate to the municipality for the note of the adoption in the population register and for the possible transcription in registers of births, deaths and marriages. Although this transcription is not compulsory, it is nevertheless advised to ask the Registry office to transcribe adoption abroad. It will then be possible to obtain a copy at any time.

Adoption is a process whereby a person assumes the parenting for another and, in effect, permanently transfers all rights and responsibilities, along with filiation, from the biological parent or parents.

The law on adoption followed in Belgium came into effect September 1st, 2005 and stipulates that every person who wants to adopt a child must follow the preparation organized by the competent community.
