Austria - Change Name for Minor


Procedure

  1. Obtain all necessary documents.
  2. Proceed to the competent authority to whose jurisdiction your case falls under and submit a request or application for name change along with all the required documents.
  3. Pay all necessary fees.

  • The child:
    • Birth certificate
    • Proof of citizenship
  • The legal guardian / legal representative:
    • Official photo identification

    • Proof of citizenship
    • Maybe marriage certificate (s)
    • Possibly consent of the other parent
    • May divorce or divorce decision with legal force confirmation
    • Possibly decision with legal force acknowledgment of the court over the custody (legal representation)

Eligibility

  • The application is made by the legal representative / legal guardian of the child
  • The child is an Austrian citizen / Austrian citizen, stateless / stateless ( or of undetermined nationality) with residence in Austria or refugees with residence or habitual abode in Austria


Note:The name change of a minor child must be requested by a parent. In the name of determining the parents have agreed basis, unless it is an upright marriage or after a divorce, a joint custody obligation. But it is sufficient explanation of a parent, when he assured that the other parent's consent or agreement can not be reached with reasonable effort. If a parent holds the sole custody of the child, the other parent must be notified of the proposed name change, and be listened to.

  • When returning to the original German form of the name - if the person has already performed this name - Total: 437.10 EUR (382.60 EUR 54.50 EUR German Federal fee and administrative fee)


Note: Since the first January 2008 applicable regulation stipulates that for the exhibition of works that are directly caused by the birth of a child, unless they are issued within two years from the birth, incurred no federal charges, concerns may also change the name. However, a document which is issued after the change of name of the child ( eg birth certificate), only toll free, when previously no such document was not issued free of charge for the child.

Competent Authority

The district administration of the place of residence or habitual residence, or the last place of residence or habitual residence in Austria:

  • The district administration
  • In statutory cities: the magistrate:
    • In Vienna: the Municipal Department 35 (even for people who never had a place of residence or have had habitual residence in Austria)

Need for the Document

Minor individuals, whether legitimate or illegitimate, have the right to change their first or family name.

Reasons for changing name

  • The minors / the minor wants the family name of his / her parents or get a parent
  • The minors / the minor wants the family name of a person obtained from the he / she his / her family name derived has and whose family name has been changed or the change has been applied
  • The minors / the minor wants the family name of the person obtained the custody of her / his plays he / she is, or in the care provided to the care relationship is not only intended for a short time


10 to 14-year-olds have the right to be heard . The name change of over 14-year-old people need their personal consent. Both rules also apply for a legitimation of illegitimate children by a subsequent marriage.


Beginning April 1, 2013 children are allowed to have double names. But this must consists at the most two parts and must be separated by a hyphen.

Legal Grounds for Changing Name

To make the change Familien-/Nachnamen, one of the legal grounds enumerated here must be:

  • The previous Familien-/Nachname acts ridiculous or offensive
  • The previous Familien-/Nachname is difficult to pronounce or difficult to write
  • The applicant / the applicant is of foreign origin, and wants a family name / her it facilitates classification in domestic:
    • This request for the name change must be made ??within two years after the acquisition of Austrian citizenship are introduced
  • The applicant / the applicant wants a family name she / he been in good faith , to be entitled to out has
  • The applicant / the applicant wants a family name she / he performed earlier right has
  • The pros and Familien-/Nachname and the day of birth , the applicant / the applicant are consistent with the corresponding data of another person so agree that it mistakes may occur

  • The applicant / the applicant intends, even after a surname Identification according to 155 Civil Code will
  • The applicant / the applicant wishes to obtain a last name that is the same as that of their registered partner / registered partner of his, so that may also be connected to the application as a highly personal, non-derivable his previous legal name preceded or followed
  • The minor applicant / the applicant to the minors last name of the person to receive that has the custody (or joint custody of the plays), or in the care she / he is and the care relationship is not only intended for a short time
  • The applicant / the applicant holds Austrian citizenship alongside another citizenship and wants a family name that he / she is already legally transferred to another staff regulations. The purpose of this name change is to perform the same name after the two native rights.
  • The applicant / the applicant can demonstrate that the change of the family name is needed to undue disadvantages in economic terms or in his / her social relationships and avoid that these disadvantages can not be averted in any other way
