Common name

It may be done by adopting either the name of the woman or man andidentifying a common family name. This is an existing name of a plurality of parts used, the entire name or parts thereof may be used.

Also acquired in a previous marriage to the family may be in a common family name following marriage. A double name from a previous marriage, however, may not be used in another marriage common family name.

Double name

The spouses may also designate a both formed from the family name double names for common family name. To avoid confusing name chains, but only one can be made ??at most two parts of existing names can be selected.

The Spouse / the spouse, her / his family name is not common surname, can already be determined before the marriage, that she / he from a common family name and his / her family name formed double name leads. This double name also must consist of at most two parts.

A double name must be separated by a hyphen between the individual parts.

Examples:

• Mr. Mller-Zepelin married woman Berger-Mayer. Common name should be Zepelin. Mr. Mueller is Zepelin Zepelin future. Ms. Berger Mayer can continue Zepelin-Berger, Berger Zepelin, Zepelin or Mayer-Mayer-Zepelin.
• Mr. Mller-Zepelin married woman Berger-Mayer. Both agree that they carry a (common) name composed of their name. They can double any name from the name parts "Miller", "Zepelin", "Berger" and "Mayer" form ( eg Mller-Mayer; Zepelin-Berger, Mayer Zepelin etc.)

Note: Spouses who were married before 1 April 2013 have closed their names from 1 September 2013 determined in accordance with these rules. Similarly, the names of children whose birth or adoption can before 1 April 2013 has been certified, from 1 September 2013 will be determined in accordance with these rules.

When a Spouse / a spouse has chosen a double name, it must henceforth be used ( eg in the passport and driving license as well as the signing of contracts).

Separate names management / maintenance of the previous family name

New rules applied beginning of April 1, 2013 states that spouses who do not determine a common family name, may maintain their previous surname.

However, it must be determined which family names their children will bear. It can be the name of the mother or father or a combination of their surnames.

A provision that the children will automatically get the family name of the mother, even if this is a double name.

Legal Grounds for Changing Name

To make the change Familien-/Nachnamen, one of the legal grounds enumerated here must be:

• The previous Familien-/Nachname acts ridiculous or offensive
• The previous Familien-/Nachname is difficult to pronounce or difficult to write
• The applicant / the applicant is of foreign origin, and wants a family name / her it facilitates classification in domestic:
  • This request for the name change must be made ??within two years after the acquisition of Austrian citizenship are introduced
