Assam - Apply to Change of Name (Deed Poll)


Procedure

Apply In-Person:

  1. To change one’s name, the candidate should obtain the notarized name change affidavit (deed poll).
  2. The candidate shall approach a notary public and request for a notarized name change affidavit (deed poll). The notary public will give the details or requirements for providing the notarized name change affidavit (deed poll).
  3. The applicant should get two witnesses to sign on the affidavit before the notary public. The applicant needs to buy the stamp paper in their name as per the value notified by the notary public.

  5. The applicant shall visit the notary along with the witnesses and provide the information and details (new name, old name, the reason for name change, address etc.) as per the notary public’s guidelines.
  6. The notary public will prepare the affidavit (deed poll) on the stamp paper and notarize it after getting the signature of the applicant and the two witnesses.
  7. With the notarized name change affidavit in hand, the candidate should place an advertisement announcing the name change with details like old name, new name, vide affidavit and address in a widely circulated regional newspaper and English newspaper.
  8. Once the newspaper announcement is published, the applicant should buy 3-4 copies of newspaper in both the languages for their future reference.
  9. The applicant should wait for 15 days or as per the timeline advised by the department from the date of newspaper announcement.
  10. If the advertisement doesn’t encounter any public objection, then the candidate shall apply for gazette publication (for recording and publishing the applicant’s name change in the official Gazette).
  11. In order to apply for gazette publication, the applicant shall approach the respective directorate / Commissionerate of Stationery and Printing.

  13. Please visit the respective office and consult with the designated authority to know the applying procedure. Please collect the application form or write on a plain A4 sheet as advised.
  14. Please complete the application form with correct address. The applicant should make sure to sign as per the old name in the application form at the given place.
  15. Attach all the documents as per the “Required Documents” section of this page and submit it to the designated authority along with the fees.
  16. Please follow the “Fees” section of this page for fees related information.
  17. Authorities will check the submitted application and documents to make sure that the required documents and details are in place. If the documents and details are in place, the application will be accepted.
  18. Authorities will make entries about this application in the manual record or electronically using computer. The applicant will be provided with a record number as acknowledgement for future reference.
  19. ”SMS” triggered update on application status will be sent to the applicant’s mobile.
  20. The application will be processed further. After the successful verification of all the documents, the department will publish the change of name in the official gazette.
  21. The update will happen in 20 days or as per the department's norms, whereas the booklet can be obtained within 2 to 3 months or as per the timeline provided by the department.
  22. Five copies of Gazettes in which the change of name is published will be sent through post or can be hand-delivered based on the applicant's request.

  10. In order to apply for gazette publication, the applicant shall also send their application by post based on the availability of the service.

  12. The applicant should write down the correct postal address without any spelling mistake on the envelope. Please affix applicable postal stamp as appropriate.
  13. Then, please complete the application form with correct address. The applicant should make sure to sign as per the old name in the application form at the given place.
  14. Please attach all the documents as per the “Required Documents” section of this page along with the requisition letter, DD for the required fees and enclose them in the envelope.
  15. Please send it by the registered post and keep the acknowledgement safe for future reference.
  16. The application will be processed further. After the successful verification of all the documents, the department will publish the change of name in the official gazette.
  17. The applicant may receive “SMS” triggered update on application status.
  18. The update will happen in 30 days or as per the department norms, whereas the booklet can be obtained within 2 to 3 months’ or as per the timeline provided by the department.
  19. Five copies of Gazettes in which the change of name is published will be sent through post or can be hand-delivered based on the applicant's request or as per the department norms.


Note:
  • While publishing the name change in newspaper, the applicants should publish one classified in daily publishing news in the local official language of the respective State and the second classified in a local English newspaper.
  • In case of a change of Initial name due to adoption, the adoptive Father/Mother should sign in the application.
  • In case both the adoptive Father/Mother are expired, the candidate shall publish in the government Gazette as a “Public Notice”.

  • In case of applicant is minor, the legal guardianship order is required if the guardian signs the application
    • Copy of marriage certificate (for married men/women to change name)
    • For change of name due to divorce, duly certified copy of judgement
    • Those who are born outside the state where they are and residing need to provide certified copy of the birth certificate or ration card/voter ID/residential certificate by tahsildar should be provided
    • For change of initial or name due to adoption, copy of registered adoption deed with attestation
    • In case of remarriage, marriage certificate
    • Life certificate from the government medical practitioner, if the applicant is 60 years and above


  • Mandatory documents required for minors below 18 years
    • Identity proof – Aadhaar card or school ID
    • Address proof – Aadhaar card or ration card
    • Age proof – Birth certificate
    • One passport size photo


Note:
  • Apart from the above documents, the authorities may ask for additional information or documents. Please provide them for processing.
  • All documents must be self-attested.
  • For minor applicants – The application form should be duly signed by minor and if possible then by parents or guardians.

Eligibility

  • Any Indian citizen can apply for this procedure.
  • Those married men/women willing to change their name or initial are eligible to apply.
  • The adopted father or mother is eligible to apply.
  • The divorced women are eligible to apply.
  • The remarried woman is eligible to apply.
  • If the applicant is 60 years and above, then they need to provide life certificate from the government registered medical practitioner.




Fees

  • The applicant shall pay the fees or charges as per the authority's advice.
  • Please pay the advised amount for the publication of change of name, including the cost of five copies of Gazettes and postage charges.
  • Cash payment can be made in the respective cash counter.
  • The applicant has to pay the notary public charges.
  • The applicant has to buy the judicial stamp paper for the value as advised by the notary public.




Validity

  • The change of name recorded/published will be valid forever. But it will be valid till the applicant changes again and applies for change of name.

Instructions

  • The application should be made by the applicant and the application must be signed by the applicant.
  • Please make sure to mention the old name.
  • The parent or the guardian of the minor applicant should sign the application for change of name.
  • The application for the change of name will be entertained only in respect of persons who are natives of the respective State. The applicant should give a declaration as appropriate.
  • The applicant should specify the punctuations in between Initials and Name accurately.
  • In the application, the applicant should sign in old name only.
  • Do not submit fake documents as a proof to get the change of name.
  • Incomplete application will be rejected.
  • Avoid spelling mistakes while filling the application form.
  • Applicant will be penalized if any information provided by the applicant while applying for the change of name is being found false or incorrect.

Need for the Document

  • Any individual who decides to change their name due to marriage, for new identity, adoption, remarriage, good luck etc. shall formally change it. However, to make such changes effective in official documents like passport, voter ID, driving licence etc. the change should be officially registered with the gazette.

  • The applicant shall change any part of the name, add or remove name, hyphens or spelling.
  • The applicants are advised to enclose a certificate issued by the Tahsildar or the designated authority to prove the nativity in case the ration card is not available.
