Procedure[edit]

Applying process in Guadeloupe for citizen and non citizen

a. Apply in-person
  1. Police Clearance Certificate can be applied at “Court of First Instance“
  2. Application forms can be obtained from the respective office on visit.
  3. Please follow as per authorities guidelines and submit the completed application along with documents. Applicant should pay for any charges if required as advised.
  4. This application will be processed by respective department.
  5. The certificate can be collected from the office where applicant applied in person or will be delivered through mail upon notification or issued as per norms.
  6. Go to the respective office. Don’t forget to take the required copy of documents along with originals to the office.
  7. Application forms can be obtained from the respective office on visit.

a. Apply through mail(post) - overseas
  1. Police Clearance Certificate can be applied at “Ministry of Justice“ through mail (post)
  2. Please mail the completed application, documents and fees paid details to….

  • This application received will be processed by respective department. The certificate will be delivered to the applicant as per norms.

  • A copy of your passport while living in Guadeloupe .

Eligibility[edit]

  • Applicant with valid passport and a valid address proof.
  • Age: 16 years and above. In case of minors, the application must be submitted by the parent exercising parental authority, if the minor has not turned 16 years.
  • The current address of the applicant must be same as in the passport and other supporting documents.
  • Applicants who are in need of residential status, employment or long term visa or for immigration to a foreign nation.

It is the applicants responsibility to contact the relevant authorities to obtain the necessary police certificates or clearances. Each countrys procedures are different. Applicants may have to apply to more than one level of government or more than one agency - municipal, provincial, state, federal and the police, courts or similar governmental agencies for the police certificate. If a police certificate cannot be obtained from any of the countries on the list, provide a written explanation why and an original letter from the police authority confirming that it will not issue a certificate.

  • French citizens born in Guadeloupe may request the certificate either from Tribunal de Grande Instance de Basse-Terre or Tribunal de Grande Instance de Pointe-Pitre
Non-Resident Requests
  • Non-French citizens and French citizens born outside of Guadeloupe should apply by mail, requesting a Bulletin no.3 at Casier Judiciaire National

Need for the Document[edit]

A police certificate is an official document issued by police or government agency of a country to enumerate any criminal records that the applicant may or may not have. Criminal records may include arrest, conviction, and possibly criminal proceedings.

Extrait de casier judiciare: The criminal record can only be requested by the person concerned or his legal representative in the case of a minor or an adult under guardianship. It can in no way, even with the consent of the applicant be issued to a third party (Article 777 of the Code of Criminal Procedure).

Be issued with the criminal record of a third party is punishable by law (Article 781 of the Code of Criminal Procedure).

The identity you provide will be verified by the Service. It must strictly comply with your marital status.

A police clearance certificate is a copy of your criminal record or a declaration of the absence of any criminal record. Police clearance certificates are different in each country and territory and may be called police certificates, good conduct certificates, judicial record extracts, pcc, etc. They are issued by police authorities or government departments and used by Citizenship and Immigration to prevent individuals who possess a risk to Country's security from entering the country.


Other uses of the Document/Certificate[edit]

In many immigration cases you may be requested by relevant Government to present Police Clearance Certificate from another country where you have resided for some time. If you are going through immigration process, you will definitely be asked for such a certificate.

"Bulletin # 3 cannot be asked to serve the national automated criminal records by the person concerned or his legal representative in the case of a minor or an adult under guardianship. Demand which shall specify the Vital Statistics interested, may be made by letter or computer communications. However, if the applicant was born abroad, if his place of birth is unknown or is under the age of twelve years, the application can only be made by letter with proof of marital status. Bulletin # 3 can also be obtained if the person concerned is in the service of the national automated criminal records and justifies identity "(Article R. 82 of the Code of Criminal Procedure).
