This procedure explains various ways to Register Copyright in Zamboanga City.

Here are the procedures on how you can register for a Philippine copyright. Registration for copyright may be done in person, through mail or online.

Apply In-PersonEdit

  1. You can deposit a physical (printed) copy of your work at the National Library of the Zamboanga City (NLP).
  2. Print two (2) copies of your work that you will register with the NLP.
  3. Complete two sets of the application form. Application Form for Copyright Registration and Deposit - Doc File, PDF(Links are provided under 'Documents to Use' Section, which you can use to download the forms.)
  4. Submit the completed application forms together with all the required documents to the NLP officer. In case the applicant is a non-resident foreigner, he/she should appoint a local authorized agent by a special power of attorney to complete the copyright application for and in his/her behalf. Also, if the claimant is not the author, a document supporting the claim such as the deed of assignment or a waiver of copyright ownership must also be submitted.
  5. Pay the registration fee.
  6. Issuance of the certificate of registration.

  1. Application for registration of copyright may also be submitted to the National Library of the Zamboanga City (NLP) through mail. Note: If the applicant is a non-resident foreigner, he/she should appoint a local authorized agent by a special power of attorney to complete the copyright application for and in his/her behalf.
  2. Print two (2) copies of your work that you will be registered with the NLP.

  4. Payment for the registration fee must be in postal money order addressed to the Director, The National Library.
  5. Send all the required and supporting documents to the office of National Library of the Philippines:

  6. One more thing, make sure that you call the NLP office first (contact numbers provided below) before you mail your application. Just to make sure that you are sending it to the appropriate address or person, and to know more about the copyright process.

Apply OnlineEdit

  1. Digital copies of your original work may be deposited or sent to the Intellectual Property Office of the Zamboanga City online via email.
  2. First, you will need to download the Request for Registration and Deposit Form (RDF) and Affidavit of Ownership (link provided under 'Documents to Use' Section).
  3. Complete the RDF and Affidavit of Ownership. Check the list of requirements and make sure to complete them before submission.
  4. Send the requirements as attachments to [email protected] with a subject line: Request for Copyright Registration_(Name of Applicant).
  5. Your request form will be assessed and a Statement of Account (SOA) will be sent to you through email containing details about how much are the fees due.
  6. You may settle the fees within a given period and through the following options:
    Credit Card
    Debit Card
    Postal Money Order payable to Intellectual Property Office (the payor must notify BCRR before proceeding to such payment option).
  7. An email will be sent to you confirming receipt of payment along with a copy of the IPOPHL official electronic receipt.
  8. Once your payment is confirmed, the BCRR will create and issue an Electronic Certificate of Registration and Deposit (ECRD) and will be sent through email to the applicant.

EligibilityEdit

Copyright covers literary and artistic works, which is understood to include every original work of authorship regardless of artistic or literary merit.

Works covered by copyright include but are not limited to the following:

  • literary works such as novels, poems and plays;
  • newspaper articles;
  • films and television programs;
  • letters;
  • artistic works including paintings, sculptures, drawing and photographs;
  • architecture;
  • computer programs;
  • and advertisements, maps and technical drawings.

If you are the author or creator of the above mentioned works, you may apply to have a copyright registered for those works under your name.

  • Total charges may vary depending on the number of claims, classes and embodiments applied. All fees are subject to 1% Legal Research Fund (LRF) as required by R.A. 3870. If the fee is below P 1,000.00, the LRF is P 10.00.

  • Big entity: with more than 100M worth of assets

ValidityEdit

Generally, the term of protection of works under copyright covers the lifetime of the author and fifty (50) years after his death. Different rules may apply, however in:

  • Works of joint authorship
  • Works of anonymous or pseudonymous works
  • Photographic works
  • Works of applied art
  • Audio-visual works

You may apply for a copyright in two ways, you can deposit a physical (printed) copy of your work at the National Library of the Zamboanga City or you may also send a digital copy of your work to the Intellectual Property Office of the Zamboanga City through email.

Need for the DocumentEdit

Having a copyright registered under your name protects your work and prevents others from using it without your permission. Being the author or creator of a body of work you can sue anyone who tries to use or copy your work and claim it as their own.

Some notes when filling up the application form:

  1. Question No. 8 refers to the date of creation of the work, which must NOT be later than the date when the application will be filed.
  2. For Original Ornamental Design/Works for Manufacture, the deposit shall be in the form of a drawing of the design and the corresponding technical description
  3. If the work applied for registration is a published work, two (2) printed copies with copyright notice printed in front or at the back of the title page if it is a book and on any clear space thereof if non-book material, shall accompany the application. The copyright notice shall be in the form Philippine Copyright 20__(year of publication) by ____________(name of copyright owner.)
    No. 8 of the application should be filled up by stating the specific date when the work is finished and likewise No. 9 be filled up to indicate when the work is published.
    A “published work” for purposes of registration means that the work has been disseminated to the public prior to its registration with the Copyright Office.
  4. If the work applied for registration is unpublished work, two (2) manuscript and/or xerox copies of the work without the copyright notice shall accompany the application.
    “Unpublished work” for purposes of registration means that the work has not been released to the public at the time of registration.
  5. Applications where the Copyright Owner is NOT the Author must be submitted along with one of the supporting documents listed above.
  6. Applications with incomplete requirements or not filled up completely will not be accepted.

Copyright maybe defined as a form of intellectual property which protects the rights of owners and creators of literary and artistic works. It refers to the main act in which, in respect of literary and artistic creation, may be made only by the author or with his authorization. Works are protected by the sole fact of their creation, irrespective of their mode or form of expression, as well as their content, quality and purpose.

Two types of rights granted to a copyright holder:

  1. Economic Rights: right of the author or copyright owner to derive financial reward from the use of his works by others.
  2. Moral Rights: right of the author to claim authorship of the work (Right of Paternity) and the right to restrain the use of his name with respect to any work not of his own creation or a distorted version of his work.

Copyright laws grant authors, artists and other creators automatic protection for their literary and artistic creations, from the moment they create it.

Recordation or deposit of your works isn’t necessary but authors and artists may opt to execute an affidavit of ownership with the National Library or the IPOPHL for the issuance of recordation and deposit.
