Apply By Mail

  1. To Apply for a Permanent Labour Certification, the applicant can approach the U.S. Department of Labor Employment and Training Administration link
  2. The applicant has to download the application form 9089 from the following link
  3. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
  4. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
  5. The applicant has to attach the photocopies of the required documents along with the application form while submitting.
  6. Mail the application form to U.S. Department of Labor Employment and Training Administration. The mailing address is given in the “Office Locations & Contacts” of this page.
  7. The applicant has to pay the prescribed fee as requested by the authority.
  8. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
  9. Then the application will be processed further. All the updates on the application status will be sent via SMS to the applicant’s mobile number.
  10. Based on the outcome of the above report, recommendation, and other internal processing, the designated authority will grant the certification.
  11. This entire process can be completed in 30 – 60 days or as per the timeline advised by the respective department authority.

  3. If the applicant is a new user the applicant has to click register and enter their credentials to register their account.
  4. After login, the applicant has to fill in all the necessary details in the application form.

EligibilityEdit

To Apply for a Permanent Labour Certification, the following requirements must first be met:

  • The applicant must have an existing permanent job offer by a U.S. employer.
  • The offered wages are required to be equal or above the DOL prevailing wage. DOL will subject this to the specific position.
  • The U.S. employer is obligated to construct and maintain an audit file with additional proof of attempts at recruitment.

Need for the DocumentEdit

  • A permanent labor certification issued by the Department of Labor (DOL) allows an employer to hire a foreign worker to work permanently in the United States.
  • In most instances, before the U.S. employer can submit an immigration petition to the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS), the employer must obtain a certified labor certification application from the DOL's Employment and Training Administration (ETA).
  • The DOL must certify to the USCIS that there are not sufficient U.S. workers able, willing, qualified and available to accept the job opportunity in the area of intended employment and that employment of the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

Labor Certification
Some immigrant visa preferences require you to already have a job offer from a U.S. employer. This employer will be considered your sponsor. For some visa categories, before the U.S. employer can submit an immigration petition to USCIS, the employer must obtain an approved labor certification from the U.S. Department of Labor (DOL).
