Apply In-Person:
- To Apply for Alien Employment Certification, the applicant has to approach the U.S. Department of Labor Employment and Training Administration link
- The applicant has to download the application form from the following link
- The applicant has to enter all the details in the application form. (Incomplete application forms are not accepted)
- Make sure that the applicant has to attach all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach the photocopies of the required documents along with the application form while submitting.
- Submit all the documents with the completed form to the Concerned officer.
- The fee for this procedure has to be paid as per the authority’s request.
- Once the verification process gets done by the officer, the applicant gets the notification from the department.
- The applicant gets the certificate by visiting the nearest office.
- The processing time for this procedure takes up to 30 days.

- Applicant must provide genuine information while applying for this procedure.
- Print legibly in ink or use a typewriter. If the applicant needs more space to answer questions in this form, use a separate sheet.
- Identify each answer with the number of the corresponding question. SIGN AND DATE each sheet in original signature.
- All copies of this form must bear the original signature of the employer or the employer's duly authorized representative with hiring authority.
- False statements are subject to Federal perjury and fraud penalties.
- The authorization of agent is completed only when the employer designates an agent to represent the employer in applying for labor certification.
- It is recommended that the employer not sign a blank form, since the employer takes full responsibility for any representations of the agent.

- Alien Employment certification is part of the sponsorship process for employers who wish to hire foreign workers on a permanent basis. The employer may assist the foreign worker in obtaining a green card on the basis of employment.
- Most employers who apply for certification are attempting to petition alien workers who already work for the same company, but in a different branch overseas.

It should be noted that not all employment-based green cards must be accompanied by labor certification for applicant aliens. The U.S. has determined that certain classes of alien employees do not need labor certification (the policy is typically kind to well-educated immigrants). The following are types of employees who are exempt from labor certification:
- Aliens of extraordinary ability in Business, Sciences, Arts, Education, or Athletics; outstanding professors/researchers; and international executives/managers (e.g., managers or CEOs of multinational companies). This group of employees is known as Employment First Preference.
- Professionals Holding Advanced Degrees, or Persons of Exceptional Ability in the Arts, Sciences, or Business (Employment Second Preference)
- Skilled Workers, Professionals Holding Baccalaureate Degrees and Other Workers (Employment Third Preference)
- "Special" immigrants, such as certain religious workers (Employment Fourth Preference)
- Wealthy immigrants who will invest $500,000 to $1 million that will create at least 10 full time jobs in the United States (Employment Fifth Preference)
