- To transfer ownership of a vehicle in West Bengal the applicant has to approach the RTO office to which your area belongs to. Following link can provide you information related to the list of RTO office : Contacts Link
- Make sure you have completed respective application
- Form 29, Form 30, Form 28 - In case of sale of vehicle
- Form 31 - In case of death of the vehicle owner
- Form 32 – In case of public auction

- Make sure you have all the necessary documents to process the application.
- The applicant should make sure they are eligible for transfer of ownership.
- Application forms can also be obtained from the appropriate RTO offices.
- Present the completed application forms as per the requisite in one of the counter and pay the appropriate fee where the officials would start processing your application.
- If the details and documents are in place then the authorities will process the application further.
- Authorities will inspect the vehicle – Especially chassis number particularly

- To transfer vehicle ownership, the applicant has to visit the official portal of the Ministry of Road Transport & Highways: Link to Portal
- In the homepage, please scroll down to “Informational Services” and click on the “more” button in the “Citizen Guide” tab.
- The applicant will be taken to the “Manual” page where all the available services will be listed.
- Please click on the name of the required service and click on “Step by Step procedure” from the drop down menu.
- The applicant will be taken to a new PDF page where the process for applying will be explained clearly.
- Please follow the steps to complete the application.

- Please use the following set of documents in respect to the process.
- 1.Transfer of ownership in case of death of the registered owner
- Application in form 31: Form 31 Link
- Legal heir certificate,
- Affidavit from other legal heir in acceptance of transferring the vehicle
- 2.For transfer of ownership – In case of sales of vehicle
- A no objection certificate granted by the registering authority
- An order of the registering authority refusing to grant the no objection certificate
- A declaration by the transferor that he has not received any such communication together with:
- The postal acknowledgement received from the registering authority where the application for no objection certificate has been sent by post.
- An application for Issue of No Objection Certificate shall be made in Form 28 (in triplicate) to the Registration Authority by which the Vehicle was previously Registered / Transferred. by affixing Rs.3/- Non-Judicial Court Fee Stamp:

- 3.For transfer of ownership – In case of purchase of vehicle at a public auction
- Application form 32: form 32 Link
- The certificate or order confirming the sale of the vehicle in his favor duly signed by the person authorized to conduct the auction
- Apart from the above said Form and documents please enclose the following documents respectively to all the procedures
- The certificate of registration
- The certificate of insurance,
- The certificate of pollution under control
- PAN card in case of 4-wheeler
- The appropriate fee as specified in rule 81.
- 2 Photograph of the applicant with vehicle clearly showing number plate
- Pollution under control certificate
- Proof of address (any one of the following): Ration Card / Electoral Roll / LIC Policy
- Pencil traced “Chassis Number” is the primary detail for applying
- Aadhaar card
- Passport size photo
- No objection certificate from the Financier if the vehicle held with Hire Purchase
- Valid Tax receipt

List of all RTO Office in West Bengal
Note: There are 18 motor vehicle offices that can be found within the premises of the respective offices of the District Magistrates. There are also 7 sub-divisional motor vehicle offices located in the premises of the offices of the concerned Sub Divisional Officers.

- In case of death of the owner – Legal heir is eligible for this procedure.

ValidityEdit
- Incase of non transport vehicles like two wheelers and cars, the registration certificate is valid for 15 years from the date of first registration, and it is renewed after every five subsequent years.
- Incase of transport vehicles like goods and passenger carriers the registration certificate is valid till certificate of fitness is valid.

InstructionsEdit
Applications to Transfer Vehicle Ownership are submitted to the Registering Authority in whose Jurisdiction the transferor and transferee resides or has their place of business.
- Transfer of Ownership of Motor Vehicle
- When the ownership of any motor vehicle is transferred within the same state the transferer shall report the fact of transfer within 14 days of transfer to the concerned registering authority.
- In case of vehicle registered outside the state the transferer (seller) should report the fact of transfer within 45 days of the transfer to the concerned registering authority.
- The transferee (purchaser) shall apply for the transfer to the concerned registering authority within 30 days of purchase.
- In case of death of a registered owner of a motor vehicle or in case of purchase of motor vehicle at a public auction, the successor who has purchased or acquired the motor vehicle should inform within 30 days & for transfer of vehicle in his name to the concerned registering authority within 3 months.
- Causes for transfer of ownership
- Transfer of ownership on sale / purchase of motor vehicle.
- Transfer of ownership on death of owner of motor vehicle.
- Transfer of ownership of vehicle purchased in public auction.
- Transfer of ownership in the name of financer.
- Transfer of Ownership on Sale / Purchase of Motor Vehicle
- You need to fill Form 29 (2 copies with seller's sign).
- You need to fill Form 30 (with signature of seller & purchaser & chassis print affixed on it).
- You need to fill Form TCA, TCR (for transport vehicle only).
- You must produce Income tax declaration in form 60/PAN number (except 2 wheeler).
- You must produce NOC (in case vehicle is purchased from other region / other RTO).
- You must produce NOC from entry tax (in case vehicle arriving from out of state whose age is less than 30 months from the date of 1st registration.
- You must produce NOC from financier if any.
- All valid documents of vehicle and required amount of Fee as specified in Rule 81 of the Central Motor Vehicle Rules 1989.
- Transfer of Ownership on Death of Owner of vehicle
- You need to fill Form 30 (affixed with chassis print on it).
- You need to fill Form 31.
- You need to fill Form TCA, TCR (for transport vehicle only).
- You must produce Death certificate of owner of vehicle.
- You must produce Succession certificate.
- You must produce Affidavit of successor.
- You must produce NOC from the financier if any.
- All valid documents of vehicle and required amount of Fee as specified in Rule 81 of the Central Motor Vehicle Rules 1989.
- Transfer of Ownership of Vehicle Purchased in Public Auction
- The purchaser should apply for the transfer of ownership within 30 days of taking possession of vehicle at public auction to the concerned registering authority (RTO).
- When vehicle auctioned is without any registration mark or with a registration mark which on verification is found to be false, the registering authority (RTO) assigns new registration mark to the vehicle in name of dept of govt. auctioning the vehicle & thereafter transfer of ownership in the name of person to whom the vehicle is sold is effected.
- Transfer of Ownership in the Name of Financier
- In case of hire-purchase, lease or hypothecation agreement if the registered owner of the vehicle becomes the defaulter, the financier of the said agreement can apply for the transfer of ownership of vehicle in his own name on following 2 conditions:
- The financier should satisfy the registering authority (RTO) that he has taken the possession of the vehicle from the owner (defaulter).
- The registered owner has refused to deliver the certificate of registration (RC) or has absconded.
- Under such circumstances financier should apply to the registration authority concerned (RTO) for the issue of fresh certificate of registration in form 30 & 36 along with Fees
- The registering authority after receipt of such an application would give the defaulter an opportunity to make any representation by serving him a notice by RPAD at his address entered in the certificate of registration (RC).
- After that the registration authority will cancel the previous certificate & issue a fresh certificate of registration (RC) in the name of financier.

- The transfer of ownership of a vehicle is to be applied in the concerned motor vehicle (RTO) office where the vehicle is registered.
- The transfer of ownership of vehicle is needed
- In case of death of the registered owner, then the application is to be made by the legal heirs of the vehicle with the required set of documents.
- The sale of vehicle also requires transfer of vehicle ownership from seller.
