Vietnam - Renew Work Permit for Foreigner

New Regulations on work permit - Labor Code on foreign employees working in Viet Nam (Decree 102):
- The implementation of the new Decree concerning foreign employees working in Viet Nam brought changes in the documents included in the dossier requesting a re-issuance of work permit. The new regulations requires a written approval from the Chairman of the provincial Peoples Committee on the employment of foreign employees.
- The new decree shortens the time of the employers request for re-issuance the work permit for the employees from the previous 10 to 30 days of the expiry of a work permit to at least five to 15 days of the expiry of work permit.
- The amount of time the Department of Labor, Invalids and Social Affairs takes to consider and settle dossiers has also been shortened from ten working days to three working days from the date of receipt of the application for re-issuance of a work permit, and after that the Department will issue the permit. Upon the re-issuance of the permit, your company will sign a new labor contract with the employee before the employee is expected to continue to work.
- Employers will need to send a copy of the labor contract and the issued work permit to the Department of Labor, Invalids and Social Affairs within five working days from the date the employment contract is signed.
Required DocumentsEdit
Dossier requesting the issuance of a work permit, must include the following:
- Official letter of the Chairman of the Peoples Committee at the level of centrally-controlled province or city where your company is located for approving the employment of foreign employees;
- Official letter requesting the issuance of work permit in accordance with regulations of the Ministry of Labor, Invalids and Social Affairs;
- Two colored photographs (4cm x 6cm size, bare head, taken frontally, clear face and ears, without glasses, white background), taken within six months of the time of dossier filling;
- Granted work permit valid for at least five days but not more than 15 days; and
- Certificate of health of the employee issued abroad or in Vietnam in accordance with the Ministry of Health.

The Government of Vietnam issued a Decree 102/2013/ND-CP detailing the implementation of a number of articles of the Labor Code on foreign employees working in Viet Nam (Decree 102). The Decree came into force as from November 1, 2013.
