Procedure

According to Vietnamese law, one can obtain copies of Birth Certificate by filing an application with the provincial Justice Department, providing all information related to the birth (date of birth, place of birth, parents’ names etc.)

Apply In-Person

Step 1: Gather all the required documents indicated in documents to use section blow.

Step 2: If you are a foreign national have all documents in English translate it to Vietnamese and notarized.

Here, you have to go to the People’s Committee For translation and notarization at the People’s Committee, to pay the required fee for each document.

Step 3: Have all translated and notarized documents authenticated.

Here, you go to the Department of Foreign Affairs. Upon entering the premises, get your ticket number by the guard house and go directly to the small office at your right behind the guard house.   Transaction fee is at 30,000 VND per document.

Step 4: Apply for birth certificate at the Justice department of your province

Pass all Vietnamese authenticated documents to the Ministry of Justice. Once you enter the MOJ, get your documents checked for completion at the small office at the right before going up the main building. If all documents are in order, you will be asked to go to the main building to pass your documents. If the child’s parents registered the birth with local authorities, the Justice Department staff will check their birth registration book and issue copies of the birth certificate. If you failed to submit the documents 60 days after giving birth, you’d have to pay a fine.

Step 5: Get the birth certificate, apply for English translation, and authentication.

You shall receive the Birth Certificate in Vietnamese which you can have translated into English in the MOJ or People’s Committee and have it notarized.

Step 6: Finally visit the Department of Foreign Affairs for authentication of the document and you can re-authenticated in your own embassy/consul.

Application from Abroad and third party

• If you are not in Vietnam, you may ask relatives or friends in Vietnam to submit application on your behalf. Each provincial Justice Department has its own requirements. Some provinces ask for a notarized Power of Attorney from an applicant to assign a person in Vietnam to obtain the Birth Certificate. Again, check with the provincial Justice Department for specific information.

• Authenticated Marriage Certificate of the parents
• Original and photocopy of the Father’s passport
• Original and photocopy of the Mother’s passport
• Affidavit of the Child’s nationality (authenticated in your own embassy/consul)
• Original and photocopy of the Landlord’s Police Registration Book
• Child Birth Registration Form from the MOJ
• Affidavit that the Person in the Father’s Passport is the same as the Person in the Marriage Certificate (authenticated in your own embassy/consul)
• Affidavit that the Person in the Mother’s Passport is the same as the Person in the Marriage Certificate (authenticated in your own embassy/consul)
• Affidavit of the Child’s Nationality from the Vietnamese government (People’s Committee)

Instructions

• According to Vietnamese law, one can obtain copies of Birth Certificate by filing an application with the provincial Justice Department, providing all information related to the birth (date of birth, place of birth, parents’ names…). If the child’s parents registered the birth with local authorities, the Justice Department staff will check their birth registration book and issue copies of the birth certificate.
  
• If the parents did not register the birth with local authorities, the parents can ask for a late registration of birth or re-registration of birth. The procedure for this process differs depending upon the province.  Applicants should check with the Justice Department of the birth province for specific information. For example, in Hanoi, applicants must submit a confirmation from the local (ward) People’s Committee stating that they have never been issued a Birth Certificate and provide all available forms of identification to prove their date of birth. In some provinces, applicants may be asked to submit statements from two witnesses in the same village who knew about the birth.
