PROCESS FOR CITIZENS & NON CITIZENS OF VIETNAM – FOR BOTH WHO LIVE IN VIETNAM AND OVERSEAS:

I. Procedure in Vietnam
a. Apply in person
  1. Applicant shall apply in-person at their nearest municipal or provincial Justice Department.
  2. Link for Justice Department contact: link
  3. If your permanent or temporary residence is unidentifiable, then apply in-person to the National Center for Judicial Records.

  5. Go to the respective office along with completed application form.
  6. Don’t forget to take the required documents copy along with originals to the office.
  7. Please talk to the authority for your requirement. As per authorities advice one has to submit the application along with documents.
  8. Applicant should pay for the certificate as advised.
  9. The certificate can be collected from the office where applicant applied in person upon notification.


II. Applying process overseas
a. Through mail(post)
  1. Applicant shall send their completed application along with required document and fees to the Department of Justice (So Tu Phap) by post. Please find the address mentioned below.
  2. This application will be processed by respective department.
  3. The certificate will be sent by mail to the address you specify or as per norms.

Country specific

  • Valid identity document (identity card, passport, driving license).
  • Address card (official certificate on personal identifier and address of domicile).
  • Valid respective “National Identification Card” as required.
  • Applicable fees (proof shall be attached as applicable).
  • Scan of the original or a certified copy of your temporary residence certificate / permanent residence certificate / temporary *residence card / permanent residence card.

Foreign national

  • A copy of your passport while living in Vietnam.
  • A copy of your permit of stay in Vietnam, passport number and place of issue as well.

In general

  • A certified copy of passport with entries and exits.

  • Valid passport (attested copy as per requirement).
  • Valid citizen proof (respective ID’s issued by respective nation).
  • Passport size photographs.
  • Birth certificate (as per requirement).

  • Email ID (useful to communicate issues with respect to your application.
  • A self-addressed envelope with or without stamps (as required).

EligibilityEdit

  • Applicant with valid passport and a valid address proof.
  • Age: 16 years and above. In case of minors, the application must be submitted by the parent exercising parental authority, if the minor has not turned 16 years.
  • The current address of the applicant must be same as in the passport and other supporting documents.
  • Applicants who are in need of residential status, employment or long term visa or for immigration to a foreign nation.

  • VND 200,000.
  • For more than 02certificates at one time, it costs VND 5,000 more for each additional certificate.

  • In case of paying in foreign currency, it shall be converted into Vietnamese

  • Fee varies for case to case. Updated fee requirement will be provided by respective authorities while applying.

If your place of permanent or temporary residence is unidentifiable, you should apply in person to the National Center for Judicial Records (Trung Tam Ly Lich Tu Phap Quoc Gia).

If you live outside of Vietnam:

If you live in Vietnam:
You should apply in person at your nearest municipal or provincial Justice Department (So Tu Phap) where you live permanently. If your place of permanent or temporary residence is unidentifiable, you should apply in person to the National Center for Judicial Records (Trung Tam Ly Lich Tu Phap Quoc Gia). According to the Circular No.07/TTLT-BTP-BCA of Ministry of Justice and Ministry of Public Security dated 08/02/1999, foreigners are entitled to obtain information about themselves while residing in Vietnam.

If you live outside Vietnam:

You should send your completed application to the National Center for Criminal Record (Trung Tam Ly Lich Tu Phap Quoc Gia) by post.

Special notes and considerations:

  • In your declaration, Form03/2013/TT-LLTP, you should state the reason why you are applying for a judicial record (i.e. Immigration purposes).
  • The judicial record is granted in Vietnamese. If you want an English translation, you may make a request when you receive your Vietnamese judicial record.

Required InformationEdit

The application must contain data:

  • name of the person (in case of change of name and surname and the original name or the original name or nickname if it is held),
  • date of birth,
  • identification number,
  • place and district of birth,
  • State of Birth
  • permanent address,
  • the alien's country of birth and,
  • citizenship,
  • sex,
  • name and surname of father
  • Name and maiden name of mother.

Need for the DocumentEdit

  • Police certificate (also called “criminal record certificate”, “police check”, “judicial curriculum vitae”, "judicial record card" or “Phieu Ly Lich Tu Phap”) mean a certificate issued by a state agency managing the criminal record database and valid to prove whether or not an individual has a previous criminal conviction.
  • You may be requested to produce this document when applying job, school and even immigration services.


Information which might helpEdit


Different between Form 1 and Form 2

For an unconvinced person:
The content of his/her criminal record certificate No.1 is almost the same with his/her criminal record certificate No.2.

For a convict:
In his/her Form 1:
  • For a convict who has insufficient conditions for remission of his/her previous criminal convictions, the words "with a previous criminal conviction" the committed crime, principal and additional penalties shall be written;
  • For a person whose previous criminal conviction has been remitted and for whom information on remission of previous criminal conviction has been updated in his/her judicial records, the words "no previous criminal conviction" shall be written;
  • For a person eligible for amnesty and for whom information on amnesty has been updated in his/her judicial record, the words "no previous criminal conviction" shall be written.



In his/her Form 2:

  • His/her remitted previous criminal conviction, time of remission, previous criminal conviction not yet remitted, date of judgment pronouncement, serial number of the judgment, the court which has pronounced the judgment, crime, applicable article(s) and clause(s) of law, principal and additional penalties, civil obligation in the criminal judgment, court fee, and state of judgment enforcement.
  • In case a person is convicted under different judgments, information on his/her previous criminal convictions shall be written in the temporal order.

How do I know I need Form 1 or Form2?
Criminal record certificate No. 1 (Form #1): shall be issued to (i) Vietnamese citizens and foreigners who resided or are currently residing in Vietnam and (ii) State agencies, political organizations and socio-political organizations who request the issuance of criminal record certificate to serve the personnel management, business registration, establishment and management of enterprises or cooperatives.
Criminal record certificate No. 2 (Form #2): shall be issued to (i) Procedure-conducting agencies who request the issuance of judicial record cards to serve the investigation, prosecution and adjudication work and (ii) at the request of individuals who want to know their judicial records. This means that whenever an individual requests the issuance of criminal record certificates for any purpose other than “to know their criminal records “, he/she must apply for the criminal record certificate No. 1 (Phieu Ly lich tu phap so 1). However, in practice, an immigration agency of a country may ask for criminal certificate No 2 (Phieu Ly lich Tu phap so 2) for the purpose of immigration to that country.

Other uses of the Document/CertificateEdit

A police clearance certificate is a copy of your criminal record or a declaration of the absence of any criminal record. Police clearance certificates are different in each country and territory and may be called police certificates, good conduct certificates, judicial record extracts, pcc, etc. They are issued by police authorities or government departments and used by Citizenship and Immigration to prevent individuals who possess a risk to Country's security from entering the country.

Police clearance (Good Conduct) Certificate is an important document which serves as a proof that the person has no criminal record or previously involved in criminal, breach of trust cases or violation of law both in his home country and during his residence in Vietnam. Both locals and expats are supposed to obtain this certificate.

Conditions and Instructions:

  • All compulsory fields should be filled in.
  • Make sure all entered information is correct.
  • Make sure all required documents are provided.

Local Requests

Applicants should apply in person for a Judicial Certificate, Version 2 (Phieu Ly Lich Tu Phap So 2) at the Provincial Justice Department (So Tu Phap) where their permanent residence is registered.
