Procedure

1. Visiting the Department of Justice.
2. Filling up 1 declaration form in the prescribed form. Download here
3. Carrying the Identity Card or passport (for Vietnam citizens), passport or laissez-passer or a Resident Card (for foreigners and overseas Vietnam citizens).
4. Bringing Certificate of Marriage Status of each side.
5. Must have the Certificate of the Competent Health Organizations.

Instructions

• Filling up 1 application form for getting married license, that have their signature and photos.
• Having the Certificate of Marriage Status or Marriage Registration Declaration certified the marital status of Vietnam citizens is not issued more than 6 months.
• And the Certificate of Marriage Status or Marriage Registration Declaration certified the marital status of foreigners is not issued more than 6 months by the competent authorities in those foreigners countries.

If the foreign law does not provide the granting of certifying marital status, it is able to be replaced by a Sworn Statement Certification of individuals that is used to prove they do not have a spouse at present, in accordance with the laws of the country where the foreigner is a citizen.

• Getting the Certificate of the Competent Health Organizations competent issued in Vietnam or overseas within 6 months, that confirm individual (male side and female side) not suffering from mental diseases or other diseases and without cognitive abilities or controlling their behavior.
• The notarized copies or copies enclosed with the original for comparison:
  • The Household Registration Book or Temporary Residence (for Vietnam citizens), the Permanent Resident Card or Temporary Resident Card or Temporary Residence Certificate (for foreigners residing permanently or temporarily in Vietnam).
  • One of the papers to prove their identity such as the Identity Card or passport (for Vietnam citizens), passport or laissez-passer or a Resident Card (for foreigners and overseas Vietnam citizens).
• In addition to the above papers, depending on the circumstances, the male and female must submit the following corresponding papers:
  • For the Vietnam citizens are doing in the armed forces or directly related to State secrets, they must submit a certificate of authority or the organization managing the central or provincial level stating that such person marrying a foreigner does not affect state secret or not contrary to the provisions of this industry.
  • For the Vietnam citizens divorced at the foreign competent authorities shall have to submit the certificate recording in the civic status about that divorce which has been carried out in the foreign countries under the provisions of the law in Vietnam.
  • For Vietnam citizens having simultaneously the foreign nationality, they must have proof of marital status issued by the competent authorities of that foreign country.
  • For foreigners not residing in Vietnam must be granted by the competent authority certifying that such foreigners is eligible to get married under the laws of that country.
  • For foreigners who did divorce with Vietnam citizens at the foreign competent authorities shall have to submit the certificate recording in the civic status about that divorce which has been carried out in the foreign countries under the provisions of the law in Vietnam.

Need for the Document

A couple (one of them is a foreigner or both of them are) who intends to get married in Vietnam must apply in person for a marriage license at the Department of Justice. The application for a license must be signed by both applicants in the presence of the Department of Justice.

Information which might help

1. The Department of Justice receives the marriage registration dossier for the case of Vietnam citizens residing in Vietnam and the Vietnam citizens not permanently residing or not registering yet for temporary residence in Vietnam according to the law of the residence in Vietnam.

In case of the foreigners getting married together, one of them has to residing permanently in Vietnam, however, in case there is nobody residing permanently, one of them has to reside temporarily in Vietnam

1. The date of interview is fixed and written directly on the filing receipts. Upon receipt of the certificate of marriage, both male and female must be at the Department of Justice and present the identity card, passport, Visa to sign the Marriage Certificate and Marriage Registration Book.
2. The documents issued by the competent authorities of foreign countries must

be consular legalization (unless they are exempt from the consular legalization) and be translated into Vietnamese as prescribed by the law of Vietnam.

1. List of countries and kinds of papers are exempt from the consular legalization, searching on website of Consular Department - Vietnam Ministry of Foreign Affairs at http://www.lanhsuvietnam.gov.vn/
2. After 5 working days since the appointed date of returning the dossiers, if the applicants do not come to get the Certificate of Getting Married, the application will be canceled (no refund of fees). In case there are plausible reasons that both male and female request an extension of time, the application must be present in papers and set a date to sign the marriage certificate, the time limit may not be extended more than 90 days since the appointed day of returning the result. Expiration of such period if they still want to get married, they are asked to redo the procedure for marriage registration.
