In what cases can be ordered name change?

It may be ordered when the name is infamous, submit to the person to public ridicule, violates their moral integrity, honor and reputation or does not correspond with their gender. Out of these reasons may be made in the name change.

The person concerned must apply in writing the name change to the Office or Unit Registrar, who will process it according to the administrative procedures for correcting records. The application must include: Identification of the person and the record to be rectified by renaming the explanation of the reasons for requesting the name change, address where notification must be made of the decision and the signing of applicant.

The decision on the name change will be performed within 8 business days.

To request the initiation of this procedure is not required to be assisted by Advocate or Attorney.

The request for correction in administrative proceedings shall contain:

  • Complete identification of or the applicant or, failing that, the person

Legal representative.

  • Identification of the record whose rectification is requested.
  • Subjects on which the application is based.
  • Identification and presentation of evidence, if such is the case.
  • address where notifications will be made to the applicant.
  • Signature of applicant or his legal representative.
  • Failure of any of the above requirements will result in the inadmissibility of the application.

Any person may change its name, for once, to the registrar or civil register when this is disgraceful, subject it to public ridicule, violates their moral integrity, honor and reputation, or not appropriate to their gender, thus affecting the free development of his personality.

If they involve child, the change is effected by parent request, mother or representative; if over fourteen teenager may request personally changing names; once achieved most age may reapply the name change only once.

In cases of family placement of children and adolescents, not will allow changing names without prior judicial authorization.

The registrar and civil register shall process the change own name, by the process of rectifying the seat administrative.

The CNE published in Official Gazette no. 40.093 dated January 18, 2013, Regulation of the Law on Civil Registry where the procedure for changing names legally established in Venezuela.

The new Civil Registration Act provides that any person may change its name, for once, before the civil registrar, when it is "shameful, subjected to public ridicule him, violates his moral integrity, honor and reputation, or not correspond to their gender, thus affecting the free development of his personality.

Whoever wants to rectify some item of civil status records must submit application to the judge, expressing her specific change its name. How to change Own Name in Venezuela

The name change is now an administrative process in which the person should go to the civil registration unit in which occurred the presentation of his birth where the case was forwarded to the city clerk, who in consideration of the criteria for the process and the reasons given by the person concerned assess whether or not appropriate, exposes a press release from the National Electoral Council (CNE), the body which since 2010 is responsible for organizing and operating the Registry of Venezuelans.

Article 146 of the Law on Civil Registry provides that any person "may change its name, for once, when it is infamous, subject it to public ridicule, violates their moral integrity, honor and reputation, or not appropriate to their gender, thus affecting the free development of his personality. "

The Vice President of CNE, Sandra Oblitas, said the decision to rename must be properly substantiated because after completion, the person must go to each of the instances which have issued documents establishing their identity for the corresponding change . Since educational titles, to licenses, contracts or property deeds have to be modified, so it is not a decision that should be well evaluated.

The President also said that the name change is different from the corrections of the proceedings for cases in which there are typos in names or cities, which may also be resolved administratively.

The Organic Law on Civil Registration was adopted in 2010, the year in which the electoral authority complied with the constitutional mandate that states that this institution should lead the Civil Registry to automatically incorporate the older the voter roll, as well as exclude the deceased.

The CNE is working on automating the registry to make them more flexible and inclusive processes. On January 29 he began to digitize birth certificates, marriage and death dating from 1990 to the present. This is done in order to protect the vital documents of citizens and expedite service identification.
