Apply In Person:
- To Apply for Guardianship Certificate, the applicant has to approach the Ministry of Justice link.
- An application form will be provided to the applicant by the concerned officer or it can be downloaded from the following link
- The petition must be filed with the court that has jurisdiction over the matter. The petition should include information about the proposed guardian, the individual in need of a guardian, and the reasons why the guardian is necessary.
- The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach photocopies of the required documents along with the application form while submitting it.
- Submit all the documents with the completed form to the concerned officer.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- The applicant has to pay the prescribed fee as requested by the authority.
- Then the application will be processed further.
- The court may order an investigation to be conducted to determine whether guardianship is necessary and, if so, who should be appointed as the guardian.
- A hearing will be scheduled in which the court will hear evidence and determine whether guardianship is necessary and, if so, who should be appointed as the guardian.
- If the court approves the guardianship, a Guardianship Certificate will be issued confirming the appointment of the guardian.
- This entire process can be completed within 4 – 6 weeks or as per the timeline advised by the respective department authority.
