Procedure

Apply In Person:

1. To Apply for Guardianship Certificate, the applicant has to approach the Ministry of Justice link.
2. An application form will be provided to the applicant by the concerned officer or it can be downloaded from the following link
3. The petition must be filed with the court that has jurisdiction over the matter. The petition should include information about the proposed guardian, the individual in need of a guardian, and the reasons why the guardian is necessary.
4. The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
5. Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
6. The applicant has to attach photocopies of the required documents along with the application form while submitting it.
7. Submit all the documents with the completed form to the concerned officer.
8. After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
9. The applicant has to pay the prescribed fee as requested by the authority.
10. Then the application will be processed further.
11. The court may order an investigation to be conducted to determine whether guardianship is necessary and, if so, who should be appointed as the guardian.
12. A hearing will be scheduled in which the court will hear evidence and determine whether guardianship is necessary and, if so, who should be appointed as the guardian.
13. If the court approves the guardianship, a Guardianship Certificate will be issued confirming the appointment of the guardian.
14. This entire process can be completed within 4 – 6 weeks or as per the timeline advised by the respective department authority.
