Marriage is dissolved by the Body of State Registration of Civil Status Acts:

  • Application for the divorce may be filed by both spouses or by either one of them. In case one of the spouses, due to some valid excuse, cannot personally submit a statement on marriage dissolution to the body of state registration of civil status acts, such notarized or similar statement may be submitted by the other of spouses on his/her behalf.
  • Once the application for the marriage dissolution is granted by the bodies of state registration of civil status acts, the divorce is legalized by the issuance of the Certificate of Marriage Dissolution, the sample of which is approved by the Cabinet of Ministers of Ukraine.


Marriage Dissolution Through a Court Procedure:

  • Application for the divorce through a court procedure may be filed by both spouses or by either one of them.
  • The court will have to determine if the application for a divorce truly reflects the actual will of wife and husband and that their personal and property rights, as well as the rights of their children, will not be violated after marriage dissolution.
  • A marriage dissolved by the court before the Law of Ukraine On State Registration of Civil Status Acts came into effect (27.07.2010) is subject to state registration with the body of state registration of civil status acts.
  • State registration of marriage dissolution may be conducted by the body of state registration of civil status acts upon notarized or equated application of one of spouses, if the act record on marriage dissolution has already been drawn up upon application of the other of spouses on the ground of courts decision on marriage dissolution or on the basis of item 3 of part one of Article 107 of the Family Code of Ukraine taken before this Law came into effect, in case such person cannot, due to a valid excuse, personally arrive to the state body of registration of civil status acts (part two of Section IV of the Final and Transitional Provisions of the Law of Ukraine On State Registration of Civil Status Acts).

Processing TimeEdit

The court will have to make a decision regarding the marriage dissolution after the expiration of one month from the date when the application was submitted. Before the expiration of this term the wife and husband have the right to cancel the application for marriage dissolution.

Need for the DocumentEdit

Dissolution of marriage or divorce is the termination of marital union between married couple. It results in cancellation of all legal duties and responsibilities between husband and wife.

There are two ways in which marriages are dissolved in Ukraine, first is by the Body of State Registration of Civil Status Acts. This is possible if spouses do not have children (Article 106 of the Family Code of Ukraine) and upon application of one of spouses if the other of spouse has been declared missing or legally incapable (Article 107 of the Family Code of Ukraine). The second way to dissolve a marriage is through a Court Procedure, application for the divorce may be filed by both spouses or by either one of them.
