ProcedureEdit

  1. If a person or establishment intends to transfer fish within Uganda for aquaculture purposes, that person or establishment shall apply for a fish transfer permit under the Ministry of Agriculture, Animal Industry and Fisheries (MAAIF) at least 3 days prior to a transit.
    • The applicant shall apply to the Chief Fisheries Officer for a permit in the Form C set out in the Rules and regulation.
  2. The applicant must attach all the required documents including the import and Export permit from the destination country to confirm that his/her fish transfers are duly authorized to enter that country.
  3. The applicant shall also attach a Fisheries health certificate attesting to the health status of the Fish, and/or safety of the products to be transferred, an invoice, packing list, Air waybill/Bill of Lading and any other relevant document.
  4. The applicant should visit the Laboratories for conducting the testing of fish and fishery products to support certification for quality and safety of fish and fishery products for the export and local market established, operationalized and maintained.
  5. A fish transfer permit shall be issued on payment of the fee set out in the Rules and regulations as prescribed by the Authority.
  6. If all is deemed safe, the Chief Fisheries officer for Fisheries Health shall authorize the transit by issuing a Fish transit permit.
  7. The Fisheries Inspector at the port of entry/exit shall perform a general inspection on the health of all Fish in transit. Where necessary, goods/products shall be disinfected in accordance to the international guidelines of the OIE before permission to transit to the next country.
  8. The transit Fish may be moved to quarantine facilities if considered necessary. The owner shall be responsible for all expense incurred during the quarantine period.
  9. Where the Chief Fisheries Officer refuses to issue a permit for transfer of any organism he or she shall communicate in writing the reasons for refusal.

Note:
The Chief Fisheries Officer may refuse to give permission for transfer of any fish if the fish to be transferred presents a danger of genetic contamination, or a danger of degradation, or a danger of loss of native species or change in species composition.

FeesEdit

Issuance of fish transfer licence or permits is contingent upon the payment of a fee. Criteria to determine the amount of fees to be paid to the licensing authorities vary.

ValidityEdit

A licence issued under this Act is valid for one year and expire on 31 December every year.

Need for the DocumentEdit

  • A person is required to obtain a valid fishing license prior to fishing in inland waters or transporting fish taken from inland waters. A person is required to keep his/her fishing license with him/her at all times while fishing or transporting fish and must exhibit their license for inspection by any warden, department employee, guide or landowner upon request.

  • No person in Uganda is allowed to export or import a live fish or any other aquatic animal without the permission of the Minister.
  • A person who contravenes a provision of subsection (1) of the fishing Act commits an offence and is liable on conviction or imprisonment for a term of five years or to both such fine and imprisonment and, in addition, the fish or aquatic animal shall be forfeited to the Uganda Government.
  • Notwithstanding the provisions of subsection (1) of the Fishing Act the Minister has the power, from time to time, export or imports a specialized species of fish or other aquatic animal for the purpose of exchange of fishery information or for research.
  • The Sea Fisheries Act provide Regulations, which state that every vessel intended for fishing to be registered with the Ministry of Fisheries Development and require vessels first to be licensed before they are transferred. They also require Specific requirements are set out for fishing vessels engaged in shrimp trawling.
