Apply In-Person

  1. To apply for the Electricity generation License, you should make your application to the Electrical Regulation Authority (ERA). You can find the ERA contact details through this link: ERA contact Details.
  2. Obtain the application form for electricity generation from the ERA office or download the form from the ERA website through this link: License application form.
  3. Complete the application form correctly and have it attested by a notary public or commissioner of oaths. Note that the application form should be completed in three copies.
  4. Prepare all the required supporting documents for your applicant in three paper copies and make a soft copy of the complete application in an electronic version i.e., in Microsoft Office software format contained in a CD-ROM.
  5. Then visit the ERA office and pay the non-refundable processing fee at the ERA cashier and obtain the payment receipt
  6. Submit the three copies of the complete application and one soft copy of the complete application contained in a CD-ROM to the ERA official at the service desk including the payment receipt.
  7. The ERA officer will receive your application and issue you an acknowledgment receipt with details of your application including the date of receipt.
  8. Then the commission will review the application and all the submitted documentation to determine if the application meets the required standards set by the ERA. At this stage, if the application is incomplete, the Authority will write a notification requesting that you furnish the required documents or information to complete the application.
  9. Upon review and your application is complete as required, within 30 days of the acknowledgment of receiving the application, the ERA will require you to publish a notice in two newspapers i.e.,one circulating in the proposed area of operation and a national circulation paper in Uganda. The notice will be published in the manner prescribed by the ERA and it should state the period within which any objection or representation in connection with the application may be made to the Authority.
  10. Submit a copy of each of the newspaper publications to the Authority.
  11. If there is no objection to your application by the public, the Authority will deliberate on the application and decide to grant the Electricity generation license or refuse the grant of the license depending on the merits of the application.
  12. Once a decision is reached, the authority will notify you in writing not more than six months after the date of receiving your application.
  13. If the authority intends to refuse the grant of the license, it will inform you of the reason for reaching the refusal and you will have the opportunity to make adequate representations to the Authority within twenty-one days of the receipt of the refusal notification from the Authority.
  14. The Authority will consider the representation you have made and if the representation is unsuccessful, the commission will notify you in writing that the application for a license has been refused.
  15. If the Authority has approved the grant of the license, the Authority will notify you in writing of the approval and the conditions to be satisfied, including the fees to be paid before the grant of the license.
  16. Pay the requisite licensing fee depending on the number of megawatts to be generated and upon the payment, the license will be prepared and issued to you.
  17. The applicant will pick the Electricity Generation License from Electricity Regulatory Authority offices after a payment of the required fees.

Required DocumentsEdit

  • Completed Application Form should be attached on the application form.
  • Certificate of Incorporation, and Memorandum, and Articles of Association, or Deed of Partnership, or Deed of Trust.
  • Registered Title Deed to Site, or Sale Agreement, or Deed of Assignment/Gift, or evidence of submission of a title deed to a relevant land processing agency (as applicable).
  • Tax Clearance Certificate for the immediate past three years.
  • Ten-year Business Plan for implementing the project should be attached on the application plan.
  • Off-take Agreement or Arrangement.
  • Environmental Impact Assessment (EIA) Approval Certificate, or Proof of submission and acceptance for processing of the Report on EIA to the Ministry of Environment, or Details on how effluents and discharges will be managed (if proposed capacity is less than 10MW).
  • Fuel Supply Agreement, or a letter from a fuel supplier and transporter indicating the inclusion of the fuel needs of the applicant in the supply plans of the fuel supplier and transporter.
  • MOU with or Letter of intent from Engineering Procurement Contract (EPC) Contractor (if applicable).
  • MOU with or Letter of Intent from the technical partner (if applicable).
  • Financing Agreements or Letter to fund the project from the financial institution(s).
  • Timelines for commissioning of the power plant and on the date when different capacities of the plant will come into operation.

  • License fees ranges from USD $ 2500 - 75,000 depending on the category and size of generator.

InstructionsEdit

  • Licensee who without lawful excuse fails to comply with any term of his or her license commits an offense and is liable on conviction to a fine not exceeding one hundred currency points and to a further fine not exceeding ten currency points for every day or part of a day during which the offense continues after conviction.
  • This License does not apply to licenses for hydro power generation of a capacity not exceeding ten megawatts.
  • A licensee may, within three years before the expiry of a license, apply to the authority for the renewal of the license.
  • Any person wishing to object to the grant of a license shall file a written objection within twenty-one days from the date of the Public Notice published in the newspaper.
  • The objection shall be filed in the form of a petition to the Commission in two paper copies and an electronic copy in Microsoft Office software format contained in a CD-ROM.
