ProcedureEdit

  1. To obtain a work permit, applicants will need to file an application with the State Migration Service of Turkmenistan (address provided below).
  2. The application must be signed by the employer.
  3. The employer will be asked to pay a rate of 25 US dollars for every month of work in Turkmenistan for the involved foreign citizen.
  4. It will take the State Migration Service about 30 to 45 calendar days to review your application.

EligibilityEdit

List of people which do NOT need to apply for a work permit:

  • Stateless people, with ID documents issued by the authorised state bodies of Turkmenistan;
  • Employees of diplomatic and consular missions of the foreign states, and also representations of the international organizations accredited at the Ministry for Foreign Affairs of Turkmenistan;
  • Foreign employees of the scientific, educational and cultural institutions created according to the legislation and the international treaties of Turkmenistan, and also official representatives of the international humanitarian and charitable organisations;
  • Correspondents (journalists) of the foreign mass media accredited at the Ministry for Foreign Affairs of Turkmenistan;
  • Foreign spiritual workers of the religious organisations officially registered in territory of Turkmenistan;
  • Foreign citizens and stateless people invited by the ministries and departments of Turkmenistan upon approval of the Cabinet of Turkmenistan for teaching, scientific and cultural-educational activity, including for carrying out in educational institutions of Turkmenistan of short-term or certain term educational trainings and seminars;
  • Foreign citizens and stateless people arriving to Turkmenistan for one month for carrying out of financial, auditing and other inspections, office negotiations, the conclusion of contracts, as experts;
  • Workers of legal bodies of the foreign states arriving to Turkmenistan for the term up to one month for installation, repair and realisation of maintenance service of the equipment;
  • Founders, shareholders, heads of legal bodies (their affiliates and representations) and foreign citizens, stateless people, legal bodies entering from administration of the head offices in other countries which are not consisting in labour relations according to the labour legislation of Turkmenistan;
  • The foreign students study under the internal form of training in educational institutions of Turkmenistan and working during free time from study and in a vacation in these institutions;
  • Conditionally condemned foreign citizens, stateless people;
  • People who are a part of crews of vehicles of the foreign states, cargoes carrying out the international transportation and passengers;
  • People to whom the refuge status is granted in Turkmenistan;
  • People recognised as refugees according to the legislation of Turkmenistan;
  • People who applied for the status of the refugee and have received the temporary certificate on registration of application for granting of the refugee status;
  • People who have received residence permit in Turkmenistan;
  • Foreign citizens or stateless people for which the international treaties of Turkmenistan define other order of their involvement to labour activity.

The work permit is valid for one year.

Grounds for refusal to issue / renew a work permit, as well as prevention of transfer of a foreign citizen from one employer to another:

  • grounds specified in the legislation of Turkmenistan for refusing a foreign citizen in visa;
  • the number involved to work in Turkmenistan of foreign nationals exceeds the quota;
  • foreign worker is invited to work, the implementation of which does not require high skills, training or expertise;
  • employer attracts foreign workers to engage in an activity not provided by its Articles of Incorporation;
  • the employer does not fulfill its obligations arising from labor and civil contract concluded with a foreign citizen, attracted to work.
  • in accordance with the legislation of Turkmenistan and international treaties towards a foreign national a decision is made on the undesirability of his (her) stay in Turkmenistan;
  • other cases specified by the legislation of Turkmenistan.



Other uses of the Document/CertificateEdit

A foreign citizen have the right to work in the territory of Turkmenistan if he/she have work permit.

The permit holder may only engage in labour activity specified on his/her the permit.
