Procedure

Step – 1: Check name availability via Online

1. The applicant has to check the name availability for the company through online via the following Link
2. The applicant has to enter the company/LLP name and active type and then click the “Search” button.
3. The applicant has to check the name. if it is available, the applicant has to register the name in the MCA (Ministry of Corporate Affairs)

Step – 2 Check the name availability via Mail

1. To Check for Name Availability to register a Company or Firm, the applicant has to mail the application to the Ministry of Corporate Affairs link
2. The applicant has to select the names and send the short-listed company names with the request letter to the MCA.
3. In return, the ROC – Registration of Companies will send the return confirmation letter for name availability.
4. Check for Name Availability to register a Company or Firm is free of cost.
5. The processing time for this availability checking takes up to 1 week.
6. Once the name is finalised, The Company must conduct an extraordinary general meeting and pass a special resolution for change of company name, and consequential changes to the Memorandum of Association and Articles of Association.

NOTE: The proposed name shouldn’t be similar to another existing company name, and it shouldn’t include the word “state.”

Need for the Document

• The name of a company is an identity or a title by which your business is recognized. The name of the company should be different, as a similar name of a company cannot exist.
• The name must be checked on MCA portal also as Trademark portal.Incorporation is the formation of a new company (A legal entity that is effectively recognized as a person under the law).If the name of the company does not fall under the rules set by MCA, then the application may get rejected.
