South Africa - Apply for Approval of Land Subdivision

Apply In-Person:
- To Apply for Approval of Land Subdivision, the applicant has to approach the respective district municipality offices link
- Note: The applicant can click on the map to explore municipalities by province, or search for any municipality, town, person, etc. using the search function.
- An application form will be provided to the applicant by the concerned officer.
- The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach the photocopies of the required documents along with the application form while submitting.
- Submit all the documents with the completed form to the concerned officer.
- The applicant has to pay the prescribed fee as requested by the authority.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- An acknowledgment receipt will be provided. Please save it for future reference.
- Then the application will be processed further. All the updates on the application status will be sent via SMS to the applicant’s mobile number.
- The land surveyor will come for a site visit for sub-dividing land.
- He/she will draw up the sub-divisional layout plans and provide a detailed motivation which will be submitted to Council.
- Once approval is obtained from the Surveyor General, a Conveyancer would assist in the registration of the subdivision in the Deeds Office.
- The applicant has to visit the office for completing the further process.
- This entire process can be completed within 30 to 45 days or as per the timeline advised by the respective department authority.

- A completed and signed application form
- Power-of-attorney letter signed by the applicant
- The bondholder’s permission for the proposed subdivision (if the property is bonded)
- A locality plan (a plan that shows the parent property in relation to its surroundings)
- A copy of an approved Surveyor-General’s diagram/noting sheet/general plan extract of the parent property
- A copy of the relevant title deed/deed of transfer Where the title deed is perhaps unclear, a conveyancer’s certificate confirms in that there are no restrictive conditions prohibiting the proposed subdivision
- A proposed subdivision plans
- A phasing plan (if applicable)
- A copy of an environmental impact assessment/heritage impact assessment/ record of decision (if required by law)
- A copy of a transport impact assessment/transport impact statement (If applicable)
- A separate civil services report (for larger developments)
- A flood line certificate and separate contour plan (if applicable)
- Typical unit types (plan and external face) (if applicable)
- Department of Agriculture approval letter (where agricultural land is involved)

Need for the DocumentEdit
- A person who has a large property and wants to divide the property into smaller stands. One cannot subdivide until the subdivided portion ends up being less than the Council permits for that area.
