Slovakia - Obtain Certificate of Slovak Living Abroad

Procedure

The application shall be filed on the official form, or that the applicant personally pick up the USZZ or at embassies. Application for a certificate shall be filed with the OSLA, Radlinskho 13, 817 80 Bratislava 15 or Embassy in the applicant's country of residence ( 7 paragraph. 6 of the Act).

USZZ decide on the request, which contains all the elements under 7 paragraph. 8 of the Act and the general regulation on administrative proceedings within 60 days of receipt.

Note: USZZ during the proceedings has the right to issue certificates requiring the applicant to submit further documents for the purpose of explaining some facts concerning him. It may invite the applicant for a personal interview.

The certificate is valid only in the Slovak Republic and the only valid proof of identity or travel document valid certificate holder

Required Documents

The application must be completed in Slovak, and accompanied by following documents (7 Law No. 474/2005):

• Any document certifying Slovak nationality (nrodnos?) or the fact that some of the applicant's direct ancestors up to the third generation had Slovak nationality. Information on Slovak nationality must be included in the document. The document could be, e.g., a school diploma or certificate (vysved?enie), identification card (ob?iansky preukaz), or military identification card (vojensk knika), an employment card, insurance card or a list of the passengers on a ship or similar.

Note: A confirmation of the Slovak nationality (nrodnos?) can be issued by Slovak National Archives or National Archives in Prague as well. This application must be submitted prior to submitting the application for the Certificate of a Slovak living abroad.

Note: It will not be possible to accept an application for the Certificate of Slovak living Abroad for further proceedings without a proof on Slovak nationality (nrodnos?).

• Any document certifying Slovak cultural and language awareness, e.g. Slovak school record of graduation.

The applicant who cannot present any document certifying Slovak cultural and language awareness may identify himself by written testimony (psomn svedectvo) of a Slovak ethnic organization active in the place of his or her residence. The written testimony should certify applicants Slovak nationality or ethnic origin and Slovak cultural and language awareness. In case there is no active Slovak ethnic organization in the applicant's place of residence, he or she may submit a notarized statement signed by at least two Slovak expatriates or Slovak citizens living abroad. The applicant must use a special form (psomn svedectvo) available at the Embassy/Consulate upon request.

Note: A notarization needs to bear an Apostille (according the Hague Convention from 5. October 1961) in order to be recognized for official use in Slovakia.

• Certificate of no Criminal Record in the Slovak Republic. The application form can be obtained from the Embassy/Consulate. Turn-around time for processing the application and its delivery from Slovakia to the applicant is approximately two months. The Certificate cannot be older than 6 months at the time of submission of the Certificate of Slovak living abroad application.
• Certificate of no Criminal Record - police background check - not older than 6 months at the time of submission of the Certificate of Slovak living abroad application.
• Birth certificate and marriage certificate of the applicant. In case the applicant wants his/her child younger than 15 years to be included in the Certificate, he/she must also enclose the child's birth certificate.
• Two recent passport size photographs (1,4 x 1,8 in). Print your name on the back of each photograph.
• Passport.
• A fee - money order or cash - paid at the time of submission of the application

Eligibility

Slovaks living abroad legislation is regulated by the Law No. 474/2005 of the Slovak Republic. According this Law, Status of Slovak living abroad may be granted to a Slovak living abroad who does not have a permanent residence in the Slovak Republic but he/she has Slovak citizenship or he/she does not have a Slovak citizenship but he/she is keeping his/her national awareness as well as he/she or his/her predecessor has Slovak nationality origin. As of January 1, 2006 the document proving Status of Slovak living abroad is a Certificate of Slovak living abroad (Osved?enie Slovka ijceho v zahrani?). Previous Expatriate Card (Preukaz zahrani?nho Slovka) is regarded as a new Certificate of Slovak living abroad until August 1, 2007. Expatriate Card is not more issued and is valid only until the end of July, 2007

Validity

The Certificate is valid in the Slovak Republic only with the holder's passport. The Certificate has no expiration date. All changes must be reported immediately to the Embassy/Consulate.

The certificate becomes invalid

• after use of the certificate for the purpose, for which it was issued,
• upon effect of a court verdict sentencing the certificate holder for an intentional criminal offence or for an offence, which constitutes an intentional criminal offence under the Slovak law, or
• on the day of certificate holders application for permanent residence in the territory of the Slovak Republic or on the day of permitting the permanent residence in the territory of the Slovak Republic.

The Office may, including upon its own initiative, decide to revoke the certificate provided that it has found that it was issued on the basis of false information or at variance with the law.

Instructions

Application for Certificate of Slovak living abroad must be submitted in person at the Slovak Embassy/Consulate General, or in person at the Office for Slovaks living abroad (rad vldy SR rad pre Slovkov ijcich v zahrani?, Radlinskho 13, 811 07 Bratislava) in Slovakia. The application will be processed within 60 days after submission. If the application is accepted, the Office for Slovaks living abroad will issue the Certificate of Slovak living abroad, which will be sent to the applicant by mail via the Embassy/Consulate.

Need for the Document

A Slovak living abroad is a person, who is not permanently resident) in the territory of the Slovak Republic and

• is a citizen of the Slovak Republic,) or
• is not a citizen of the Slovak Republic, but maintains his/her national awareness, and he/she or his/her direct ancestor) is of Slovak ethnic origin.

National awareness means active demonstrations of being part of the Slovak nation and recognition of values representing the Slovak language, Slovak cultural heritage and traditions.

State support of the Slovaks living abroad means a system of measures of the Slovak Republic as part of the state policy of care for the Slovaks living abroad focused on the support of national awareness and cultural identity of the Slovaks living abroad, on the support of their institutions to achieve this purpose, and on the support of relations between the Slovak Republic and the Slovaks living abroad.

Pursuant to 7 paragraph. 1 of the Act. 474/2005 Coll. on Slovaks living abroad and on amendments to certain laws (hereinafter the "Act"), the status of a Slovak living abroad for the purposes of the rights or benefits provided for by special laws for Slovaks living abroad demonstrated by a certificate. Certificate issued by the Office for Slovaks Living Abroad (hereinafter "OSLA").
